J&K starts issuing domicile certificates; suffering finally ends, says Valmiki community

Jammu, June 24: Over seven months after the abrogation of Article 370 and 35A, the Jammu and Kashmir administration has started issuing domicile certificates to the permanent and non-permanent residents who have lived in J&K for at least 15 years.
As per the domicile law, non-permanent residents who have residency proof of at least 15 years in J&K are entitled to get domicile certificates. The process for issuing the domicile certificates has begun and long queues can be seen at tehsildar offices these days. Online application facility has also been made available to avoid these long queues.
“I have applied for domicile certificate. My parents are originally from Bihar. Our family is living in Jammu since 1972 when my father was posted to J&K. Now, we too can become permanent residents. I’m so happy today,” said a man who submitted his application at Tehsildar office in Trikuta Nagar, Jammu.
“We verify the documents of applicants after receiving it. Once verification is done, certificates are issued to the applicants. This takes 2-3 days time. People can also apply online for getting domicile certificates. We are also ensuring that social distancing is maintained by people while submitting their applications in view of coronavirus pandemic. So far, 82 certificates have been issued from our office,” said Dr Rohit Sharma, Tehsildar, Bahu, Trikuta Nagar.
Prior to the abrogation of Article 370 and 35A, people from other states were not entitled to get Permanent Resident Certificates (PRCs) due to the state subject laws -- a byproduct of Article 35A. As a result, many communities in J&K faced injustice and discrimination due to the state subject laws. West Pakistan refugees who came to J&K in 1947 after the Partition were never given civil and political rights. Gorkha community also faced discrimination.
Members of Valmiki Samaj who have been living in Jammu since 1957 were also denied educational and employment rights due to the special state subject laws in J&K. In 1957, the government of J&K had brought members of Valmiki community to Jammu after local sanitation workers went on a strike. At that time, the Valmiki Samaj was assured that they will get all rights, but for more than six decades, the community was denied government jobs and admission in professional colleges.
What was more tragic that Valmiki community members who had postgraduate degrees couldn’t apply for government job other than that of a sweeper. India Today spoke to the representatives of the Valmiki community who expressed their gratitude to Prime Minister Narendra Modi.
“We have suffered a lot for last 62 years. Our youth was denied rights. No matter how much their educational qualification was, they could only apply for the job of sweeper. Now, after the abrogation of Article 370 and 35A, youngsters are excited. They hope to live a dignified life now. They can chase their dreams. We would like to thank Prime Minister Narendra Modi and Union Home Minister Amit Shah for taking bold decision to abrogate Article 370 and 35A,” said Gharu Bhatti, President, Valmiki Samaj to news agency .
Prior to the revocation of Article 370 and 35A, spouse and children of women married to men from outside J&K were denied permanent resident rights. But men married to women from outside J&K, didn’t face such problem.
Now, after the abrogation of Article 370 and 35A, the gender injustice in J&K has ended. Children and spouse of women married to men from outside J&K can also become domiciles of the UT. “Abrogation of Article 370 and 35A has allowed me to bequeath my identity, my culture, my roots to my children and future generations. It has enabled them to become a part of the process of rebuilding J&K,” said Navneet Kour, a social activist from Jammu married to an Army officer from outside J&K while speaking to news agency .
