High Court stays demotion of XEn as Work Supervisor

Jammu, Oct 26: The Assistant Commissioner Development (ACD), Baramulla who is also holding the charge of Project Officer Self-employment, has sought directions from the Director Rural Development Kashmir for further action as a case of demotion of Executive Engineer, Rural Engineer Wing (REW), Baramulla as Work Supervisor has been stayed by the High Court. According to sources, the High Court in Srinagar has stayed government order in which the XEn REW Baramulla was demoted as Work Supervisor. “Abdul Qayoom Chalkoo was reverted back to his original position as daily rated worker vide government order no. 63-RD of 2020 dated 12/03/2020 and same was communicated to this office the directorate of Rural Development Kashmir vide DRDK/Estt/20193, dated 21/04/2020”, the ACD Baramulla wrote to Director RDD after at least six months after HC stayed Govt order.
“The High Court, J&K Srinagar passed an order on 13-042020 and issued on 16-06-2020 which is reproduced as “in the meantime, status of the petitioner as it existed prior to issuance of impugned order No,63-RD of 2020 dated-12/03/2020 passed by the Govt shall not be disturbed”, the ACD read vide letter no PO/SE/60-64, dated 16/10/2020, quoting HC’s order and sought directions for release of XEn salary. “Issue directions for further course of actions, as the officer is continuously working as XEn, and salary of incumbent has been released by the account officer to Project Officer Self Employment (PO DRDA)”, the ACD’s letter divulged and added, “But this office has not received any communication regarding the issue except HC’s order. So this office is not in position to release salary or accept the official papers, without directions from higher ups.”
It is pertinent to mention here that J&K Government had constituted a committed vide order No:541 JK(GAD) 2020 dated:-08-05-2020 to enquire into the issue of illegal promotion conferred upon Abdul Qayoom Chalkoo Executive Engineer (REW) Baramula. The Committee headed by Secretary Rural Development and Panchyati Raj, Director General Accounts & Treasuries and Secretary (Legal) JKGAD was asked to submit its report by 05/06/2020.
