Jammu, May 10: The Revenue Department Kathua seems in no mood to implement High Court order on attestation of land mutation of a private land and is continuously delaying it due to alleged involvement of the notorious brother of a former minister.
It has been eight years, the matter has not been settled by the Revenue Department and the plaintiff has been put to harassment.
As per documents available with the Early times, J&K High Court had passed order on 26/7/2016 to attest the Virasti Intkal mutation no 1150 January 2014 within 4 weeks, in favour of Sharat Chander Nagra S/o Late Mela Devi W/o Late Kirpa Ram R/o Rakh Hoshiari, Kathua which was not honoured. Later in a complaint to CBI in this connection, which wrote to Director Anti Corruption vide letter no 1529 dated 05/12/2019 no action was taken till date.
The complainant said that the mutation No.1150 was completed in January 2014 with his statement as well as other five witnesses who are ex-army personnel and there was no any objection from any corner while sanctioning the said mutation because at that time Tehsildar, Naib-Tehsildar, Patwari, Numberdar, Chowkidar and 20-25 other co-villager at Lachhi Rakh, Kathua, were present there while the mutation was read over and explained in the presence of all the persons stated above. It was further told that the certified copy of the mutation can be obtained after the lapse of one month. The undersigned applied for the certified copy of the said mutation on dated 26.02.2014 but the concerned Kanungo / dealing hand told that he has not yet received the mutation file. Thereafter, the applicant had been paying visits to the concerned Naib Tehsildar namely Hem Raj, who had been lingering on the matter on the one pretext or the other. Then on 29.04.2014 the complainant approached the ADC/ Tehsildar and made request for issuing directions to the lower staff to provide the certified copy of the mutation who directed the Naib-Tehsildar to issue certified copy of the mutation because there was no any objection such as blood relation objection.
Thereafter, the Naib Tehsildar produced an undated complaint filed by Swaran Singh S/o Beela, R/o Chak Ram Chand, Kathua, who was crusher laborer of Sohan Singh brother of Ex. Minister, whereby it has been written in the said complaint that the undersigned was son of Savitri Devi. The said Swaran Singh also attached voter list of Savitri Devi and the applicant, with the application. On perusal of the said complainant, the presiding officer/Tehsildar asked the Naib Tehsildar as to how Savitri Devi and Sharat Chander Nagra are mother and son as the age of Savitri Devi is written in the voter list as 67 years and that of Sharat Chander Nagra is 66 years.
Then on 11.06.2014 the complainant filed a petition before the Deputy Commissioner, Kathua on dated 10/1/2015 after listening to him, and examining the record thoroughly, DC directed to Headquarter tehsildar to sign on mutation no. 1150 January, 2014 within 15 days.
The reason behind this for not signing the mutation was that the opposite party wanted to use the blank thumb marked papers of the mother of the applicant namely Mela Devi which was obtained by the Deed Writer on 06.01.1997 due to her week eye site, when she executed a will and got registered a General Power of Attorney in the name of applicant and further they want to use the blank signed papers of the applicant which were obtained on 20.01.2014 under pressure by the Naib-Tehsildar Hem Raj at the time of sanctioning of mutation No.1150 in the presence of 20-25 persons.
When Early Times contacted the DC Kathua, he said that some issues has come to fore regarding witnesses, who were present during registration of the mutation due to which mutation has not been attested till date.
