Jammu, Feb 2: The outgoing Vice Chancellor of Kashmir University is literally on a rampage and is issuing orders after orders at a time when he can't make any selections in view of the expiry of his three-year term.
In the past one week to 10 days, documents accessed by this newspaper reveal that at least half a dozen orders have been issued by the university administration with due approval of the Vice Chancellor Professor Talat Ahmed, who is presently only an In-Charge VC mandated to look after the university's routine affairs.
Early Times is in possession of copies of the University Act and these orders which includes direct promotion of an Assistant Registrar as Deputy Registrar without the concurrence of the University Syndicate which is the determining authority for such promotions. Playing tactful, the University order for the promotion of this allegedly blue-eyed AR, Mushtaq Ahmad Mir, mentions that the promotion shall be "subject to ratification by the Syndicate" when the rules say that the Syndicate should have been approached for concurrence prior to issuance of the promotion order.
On 01.02.2022, the Joint Registrar Academic Section has issued another notification which reads, "Consequent upon completion of the term of Prof Muzaffar Ali Andrabi, the Vice Chancellor in exercise of powers vested in him has been pleased to authorise that Professor Gowhar Bashir Vakil, Director IOT Zakura shall hold the charge of Dean, School of Engineering with immediate effect till further orders."
The notification has, however, been issued in total violation of the University Act which confers powers on the VC to nominate Dean of each Faculty by rotation according to seniority.
As per provisions of the University Act, the Vice Chancellor instead of giving charge of Dean to Director IOT till further orders should have nominated Prof Muzaffar Ali Andrabi for the second term in accordance with Section 29 of the J&K Universities Act which reads, "No person shall hold the office of Dean for more than two consecutive terms except where there is no other person eligible to hold the office." Prof Andrabi had held the term of Deanship only once, but was denied the second term in violation of the University Act because of lack of proximity with the University Power Center. He is considered to be blunt and having opposed VC's several moves and decisions in the past three years, sources said.
On February 3, the University administration issued two more orders appointing Dr Imtiyaz Ahmad, Associate Professor, Department of Zoology as Chief Proctor of the University and appointing Prof Showkat Ahmad Shah, Dean, Faculty of Education, as Director, Directorate of Physical Education and Sports.
According to orders, copies of which are with Early Times, both Dr Imtiyaz and Prof Showket have been given the assignments "till further orders, in addition to their own duties".
According to the University Statutes and Regulations, the Chief Proctor of the University shall be appointed by the Syndicate on recommendations of the Vice Chancellor and shall hold the office for a period of two years extendable by another two years. However, in case of Dr Imtiyaz, the order has neither been issued in anticipation of the approval of the University Syndicate not for a period of two years as mandated in the Statutes and Regulations (Section 1.0). In the case of Prof Showket, the order appointing him as Director Physical Education doesn't mention him to be the "In-Charge Director" which should have been clearly mentioned because this is not a fully-fledged appointment made through any selection committee.
Pertinent to mention that the orders of Professor Vakil as Dean School of Engineering and Prof Showket as "Director" Physical Education also run contrary to the Vice-Chancellor's much-hyped "One Man One Post" policy, leading to allegations of favouritism in making selections to such positions in a hasty manner overlooking University policies and rules.
Senior University teachers are also aghast saying issuance of such orders should have been left to the new Vice Chancellor because it is both unethical and illegal for any outgoing VC to issue any selection orders at a time when Search Commitee has already been constituted to appoint the new VC and is currently doing its job.
"The Raj Bhawan would normally restrain all VCs to not make any selections or take any policy decisions immediately after the Search Commitee is constituted. But KU seems to be an exception where Statutes, Act and Regulations are allowed to be flouted every day," said senior KU teachers who know such rules.
These decisions are taken when even the University Registrar Dr Nisar is serving as In-Charge Registrar after expiry of his three year term on 12th of this month.
The university administration has already drawn bad press for going ahead with selection process for appointment of seven posts of Assistant Registrars despite these posts having lapsed.
Teachers have again sought LG Manoj Sinha's intervention in restraining VC and Registrar from undertaking any recruitment/selection process till the new VC is appointed so that Statutes, Act, Rules and Norms are not flouted by anyone.
"Many more orders have been issued which have not been made public only because they involved violations. The University is dodging the Chancellor's office which is watching the whole mayhem for unknown reasons," the University teachers alleged.
