HC directs JDA vice-chairman to file action taken report | Illegal allotment of hall to Azad's brother at Bahu Plaza | | JAMMU, June 9 (JNF): In the controversial allotment of hall No 209 in South Block at Bahu Plaza here made by JDA in favour of Ghulam Nabi Azad's brother Sajjad Ahmed Bhat, high court judge, Justice Hasnain Massodi today directed the JDA vice-chairman to file an affidavit regarding action taken in the wake of court order whereby the cancellation order was set aside and also the allotment order of the hall was cancelled. He directed the JDA vice-chairman to file affidavit within two weeks with a copy to the petitioner's counsel. Bhat's counsel insisted that allotment made in favour of his client stood cancelled by the government and the petition was resultantly rendered inconsequential and redundant. His another counsel stated that though allotment order was cancelled, the cancellation order was quashed at the instance of Bhat and others and that the respondents were directed to adopt the procedure before passing an order, cancelling the allotment order. The court observed that in the said background, the impugned allotment order was live and in operation as much as Bhat was willfully avoiding to proceed in the matter in the light of observation of the court made in the petition and in the said background the cause to maintain petition survived. It is worthwhile to mention here that on the last date of hearing, AAG had filed a status report on behalf of commissioner, housing and urban development department wherein it was submitted that the government had already issued show cause notices, seeking cancellation of allotments to all the 30 allottees, excluding Shamsher Singh, son of Nanak Singh of 11, Gandhi Nagar (extension) whose allotment already stood cancelled by the respondents which is a subject matter of challenge before the high court. The allotments of various shops and halls at Bahu Plaza were cancelled by Azad when he was J&K chief minister after it was alleged that the allotments were made on first-cum-first serve basis and without holding any public auction.
