BDO gets penalty notice
SIC directs to refund Rs 6700 with interest

Srinagar, Dec 24: State Accountability Commission has issued penalty notice against a BDO in Doda district who even after depositing an amount of Rs 6700 as xerox fees , denied the information to the information seeker under Right to Information Act (RTI) .
While taking this issue seriously the State Information Commission (SIC) directed the BDO to refund the amount along with interest.
Details available with Early Times reveal that one Nisar Ahmed Lone R/O Bagla Doda filed an application under RTI Act before the Public Information Officer - PIO/Block Development Officer, Dali Udhyanpur, Doda regarding works executed in the Block along with photo copies of cash book, list of vendors for supply of material, details of expenditure, details of cement purchase etc.
Vide communication dated 09-12-2017, the PIO informed the appellant to deposit an amount of Rs. 6700/- on account of Xerox charges . Information seeker accordingly deposited the photo copy charges of Rs. 6700/- on 26-12-2017. When the PIO failed to provide information to the appellant even after depositing copying charges by him, the appellant filed subsequent appeals.
The appeal came up for hearing before the Commission on 14- 11-2018. The appellant submitted that the PIO has failed to provide the information to him even after he was made to deposit a sum of Rs. 6700/- as photo copying charges.
The State Information Commissioner Mohammad Ashraf Mir directed PIO to reimburse/return the copying fee deposited by the appellant along with interest as per the prevalent bank rates from the date he has deposited such fee till the date it is reimbursed to him. He also directed to furnish complete information to the appellant free of cost within a period of two weeks from the date of receipt of this order.
