Kishtwar, Oct 31: Deputy Commissioner Kishtwar has ordered magisterial enquiry into Rattle Power Project tragedy, which left four people dead and seven others injured.
As per the details available with Early Times, Kishtwar Police alos have registered two FIRs against construction company Megha Engineering for criminal negligence- The subsidiary company engaged by NHPC in construction of Rattle Power Project.
The FIR No. 265 & 266 of 2022 registered U/s 304/336/337, 287 IPC the copies of which are available with this newspaper narrated the horrific tale of the events involving two back to back fatal landslides at under construction project site highlighting the criminal negligence adopted by the construction company while executing the construction at project site. Even though, Megha Company has been named in the FIR, but none of its officials has been named.
The sources inform Early Times that the investigation is already underway.
Deputy Commissioner Kishtwar Dr. Devansh Yadav has ordered a magisterial enquiry into the tragedy. As per the enquiry order issued by District Magistrate Kishtwar vide No.:-DCK/PS/2022/3147 Dated 31-10-2022, Additional Deputy Commissioner Kishtwar has been appointed as an enquiry officer.
“Fatal landslide incident at Project site Rattle HEP, Drabshalla on 29-10-2022 in which 04 persons died and 07 others injured - conduct of magisterial enquiry thereof” read the subject of the enquiry order issued by DC Kishtwar which stated that “Fatal landslide incident occurred at Rattle HEP, Drabshalla on 29-10-2022 in which 04 (four) persons died and 07 (seven) others injured after back to back landslides hit at project site of Rattle Power Project at Drabshalla; and Whereas, reportedly, a driver identified as Manoj Kumar S/O Hari Lal R/O Guijar Kothan Drabshalla while working at project side on 29-10-2022 got trapped under debris when the excavator of the said driver was hit by a landslide, who later died on spot;” read the order.
The order further stated that, during rescue operation carried by more than dozen persons including police cops to retrieve the body of the driver another land slide hit the spot and rescue team came under debris in which 03 (three) persons died, besides 07 (seven) others were injured & there is need to assess safety/rescue facilities available on site and response of project teams in the event of disaster.
The DC Kishtwar in his order also termed the safety audit of all sites is necessary by RHEP authorities for safe resumption of activities.
“In the backdrop of above, Sh Kishori Lal Sharma (JKAS) Addl. Deputy Commissioner /Additional District Magistrate, Kishtwar is hereby appointed as an Enquiry Magistrate, who shall conduct detailed enquiry into the whole episode and shall furnish the magisterial enquiry report along with the specific recommendations in this office within 15 days positively. Further, ALC, Kishtwar, XEN R&B (PWD) Kishtwar, District Mineral Officer, Kishtwar, CMO Kishtwar and AEE Mechanical Division Kishtwar shall assist the Enquiry Magistrate in the time bound completion of the enquiry
The Chief General Manager, RHPC, Rattle HEP, Drabshalla and Ic Project Head, Megha Engineering, Rattle HEP, Kishtwar are directed to provide full assistance / relevant records to the Enquiry Magistrate as and when sought by the Enquiry Magistrate. Matter Time Bound.” The order reads.
