According to the CBI, a case has been registered against the accused, Patwari, based on a complaint. It was alleged that the accused Varun Choudhary Patwari demanded a bribe of Rs 50,000 from the complainant for issuing Girdawari land owned by him.
The CBI laid a trap and during the trap proceedings, the accused asked the complainant to hand over the bribe amount to his associate, a Chowkidar Dayal Chand, Halqa Nanga, District Samba (J&K). Special Judge CBI Jammu Bala Jyoti after hearing both the sides rejected the bail applications and observed that the applicant is accused of serious corrupt practice who was caught by the CBI, ACB Jammu red handed in a trap laid down on the basis of the complaint.
Investigation is still at its infancy and many more skeletons are likely to tumble , besides as per I.O, many material witnesses are yet to be examined including complainant, hence to my mind it is premature to admit the accused/applicant to bail at this stage.
u Bala Jyoti after hearing both the sides rejected the bail applications and observed that the applicant is accused of serious corrupt practice who is caught by the CBI, ACB Jammu red handed in a trap laid down on the basis of the complaint of the complainant namely Avtar Singh besides investigation is still at its infancy and many more Skelton tumbled or likely to come, besides as per I.O, many material witnesses are yet to be examined including complainant, hence to my mind it is pre-mature to admit the accused/applicant to bail at this stage as till date, he has failed to carve out a case for bail in his favour Thus prayer made herein is declined and application for bail at this stage is rejected, however the applicant is not debarred from filing fresh application if there is change in the circumstances.
