BJP corners Cong on Art 370 resolution

Jammu, Nov 6: Within minutes after the Jammu and Kashmir Assembly passed a resolution for the restoration of the Special Status, the opposition BJP seized this opportunity to corner its arch-rival Congress for supporting the restoration of Article 370.
“The stand of the National Conference is very much clear on this issue but the biggest question of the role of the Congress in the entire episode”, the BJP leader said.
“We asked Congress president Mallikarjun Kharge and party leader Rahul Gandhi to clear their stand on the demand of the restoration of Article 370”, the BJP leader said, adding, “Six Congress MLAs in the Assembly supported the resolution for the restoration of Article 370 because they were thumping their benches when the resolution was moved by the Deputy Chief Minister Surinder Choudhary in the House”.
“If the Congress high command has given consent to its MLAs to support resolution for the restoration of Article 370 then BJP will make it a national issue”, the BJP leader said, adding, “If Congress MLAs have not supported the same then the resolution is defeated in the House”.

The BJP leader said that the resolution passed in the J&K Assembly has no constitutional validity because the Parliament and Supreme Court are supreme.
“The Parliament of India has given its consent for the abrogation of Article 370 and this decision of the government was also endorsed by the Supreme Court. The J&K Assembly has no power to challenge the decision taken in the Parliament, which was also acknowledged by the top court of India”, he said.
“The resolution was moved in the Legislative Assembly in a clandestine manner as it was not listed in today’s business. We had to debate on the Lieutenant Governor’s address but the Speaker allowed the introduction of the resolution with the connivance which is totally illegal and unconstitutional”, he said.
The BJP leader made it clear that the National Conference leadership was living in a fool’s paradise as far as the restoration of Article 370 was concerned. “J&K Assembly has no power to restore the discriminatory Article 370 and 35-A”, he asserted.
