JAMMU, Dec 5: After misusing his official position as in-charge Secretary of the Jammu and Kashmir Legislative Council (LC), by promoting several gazetted officers beyond his competence, the officer who was until recently Law Secretary is said to be taken to task for his involvement in backdoor appointments in Khadi Village Industries Board (KVIB).
Details available with Early Times reveal that Abdul Majid Bhat ( ex Law Secretary) who was recently posted as Secretary Cooperatives & Tribal Affairs was appointed as Controller Examination to conduct the "sham" exams (written and interviews) for various posts in KVIB which is under scanner of Governor administration. Government had constituted an inquiry committee headed by Home Secretary R K Goyal to look into these backdoor appointments. Sources say that Abdul Majid Bhat might also face action for his dubious role in conducting those sham exams (written test and interview).
As reported already Abdul Majid Bhat, who was removed from the post of Law Secretary last month for misusing his official position by promoting Gazetted Officers in the J&K Legislative Council. The competence to issue such orders was with the Chief Minister or Governor only. Now he might face axe for his role in conducting KVIB exams.
According to the Jammu and Kashmir Government Business Rules (Item 22 of The Third Schedule (Rule 31(1), Secretary of the Jammu and Kashmir Legislative Council has no powers to make appointments or order promotions to the rank of Under Secretary or above.
The said rules say that gazetted officers' promotions in State Legislative Council from Under Secretaries to Additional Secretaries have to be approved by Chief Minister in coordination with Chief Secretary. And the promotion of Special Secretary has to be approved by the Cabinet after clearance by establishment cum selection committee. During Governor’s rule these powers are vested with Governor and State Administrative Council (SAC). Majid had bypassed all these rules sources said.
During 2018 alone the said officer issued three promotion orders to the gazetted officers of the Council illegally, two of them were issued in favour of Ishfaq Ahmad Wani a backdoor appointee himself who has now been promoted as Special Secretary to Government. This was Ashfaq's 2nd promotion in the year 2018. Pertinently in April this year Ashfaq was promoted as Additional Secretary in State Legislative Council vide order No: 209 -LC o- 2018 Dated 17th April 2018. The said promotion order was not at all cleared by CM Mehbooba Mufti sources say.
On the other hand Governor's administration is likely to order cancellation of all illegal recruitment's in KVIB in the last two years as the Goyal Committee has finally submitted its inquiry report after eight months to the Chief Secretary recently. The three member commission comprising Chairman R.K. Goyal (Principal Secretary Home), Dr Pawan Kotwal (Principal Secretary Health and Medical Education) and Farooq Ahmad Shah (Secretary Irrigation, Public Health Engineering & IFC) have completed the report by November end and submitted it to Chief Secretary BVR Subramanium
Following massive criticism and allegations of favouritism in selection of Junior Statistical Assistants and Executive Officers in KVIB, then CM Mehbooba Mufti had announced a thorough investigation. Those allegedly selected through fraudulent means, according to these reports, included Chief Minister's cousin and son of her maternal uncle and then PDP Vice President Sartaj Madni.
" We are unable to understand why Abdul Majid Bhat ex Secretary Law was appointed as Controller examination to hold the exams for selection of Executive officers and other posts in KVIB ? It is clear case of nepotism as this officer was very close to ex Vice Chairman KVIB Pirzada Mansoor. I am sure Goyal Commission has taken a note of this " said Adil Mir (name changed) an aspirant for KVIB posts
