DB expresses displeasure over non-implementation of order Shetty Pay Commission 2/13/2019 10:54:56 PM Early Times Report Jammu, Feb 13: In a petition is filed by the employees borne on the cadre of Subordinate Courts through JEWA State President Mangat Ram Parihar & Ors seeking implementation of Shetty Commission Report so far as recommendations pertaining to the Ministerial staff working in the Subordinate Courts in the State of Jammu and Kashmir are concerned, a Division Bench of State High Court Comprising Chief Justice Gita Mittal and Justice Tashi Rabstan expressed displeasure for non-implementation of orders. DB observed that by order dated 9th of March, 2016 passed in SWP No.53/2011, a Division Bench had directed the respondents to implement the recommendations of the Shetty Commission. As this order was not complied with, the petitioners, who are staff of the District Courts were constrained to file a contempt (SWP) No.493/2016 against the then Chief Secretary and other Officers. During the pendency of the Contempt Petition, learned counsel for the respondents submitted that the Finance Department had conveyed its concurrence to the decision taken in the meeting held on 01.08.2017. After perusal of the aforesaid status report, learned senior counsel for the petitioners submits that the benefits of advance increment at the existing pay scale instead of initial pay-scale is required to be granted and the respondents are under an obligation to create 53 posts of Section Officers as per the recommendations of the Shetty Pay Commission. DB observed that it appears that the directions of the Division Bench as well as the recommendations of the Shetty Commission have not been complied with in entirety, as a result , second contempt petition being CPSW No.750/2017 came to be filed against the then Chief Secretary and others. Despite service, the respondents have not cared to even file response to this contempt petition. DB further observed that petition relates to the extreme shortage of staff in the District Courts which has direct impact on the dispensation of justice by subordinate judiciary of the State of J&K and directed to place a copy of this order before Chief Secretary.   Share This News with Your Friends on Social Network     Comment on this Story
