| Crime Branch Jammu chargesheets 4 accused | | Unregistered Finance Company Fraud Case | |  Early Times Report
Jammu, Sept 30: The Economic Offences Wing (EOW) of Crime Branch Jammu has filed a chargesheet before the Ld. Court of 3rd Additional Munsiff JMIC Jammu, against four key individuals associated with JVG (Johar Veer Goga), an alleged unauthorized non-banking finance company, in connection with FIR No. 26/2010 U/S 420, 406 and 120-B RPC.
The case was registered on the basis of a written complaint lodged by Shri Pran Nath Peshin, S/o Sh. Tirloki Nath, R/o Gangyal, who alleged that he had invested Rs. 3.00 lakh in JVG during 1996-97 and was issued fixed-deposit receipts by its Manager, Amrik Singh Sambyal. The amount was not repaid upon maturity, following which the office of the company was found closed.
During investigation, it was established that the accused persons, including Managing Director Vijay Kumar Sharma, Directors Col. Tirpath Singh Bhan and Mohan Chander Joshi, and Manager Amrik Singh Sambyal, had allegedly operated the company with a common intention to deceive investors and secure wrongful personal gain. Verification conducted with the Registrar of Companies (ROC), Reserve Bank of India (RBI) and Securities and Exchange Board of India (SEBI) confirmed that JVG was not registered with the concerned regulatory authorities. Forensic examination conducted by FSL Jammu further confirmed that the fixed-deposit receipts issued to the complainant bore the genuine signatures of Manager Amrik Singh Sambyal, thereby corroborating the issuance of the disputed receipts.
The case investigated by Inspector Sameer Ahmed Batt reveals that the principal amount of Rs. 3.00 lakh was subsequently recovered by the complainant’s family after a lapse of approximately 18 years. However, such subsequent financial restitution does not, by itself, extinguish the alleged criminal liability arising from the original transaction. During the investigation, verification teams were also deputed to Uttar Pradesh, Maharashtra and New Delhi, where material concerning Managing Director Vijay Kumar Sharma and alleged involvement in other fraud cases registered by the Economic Offences Wing, New Delhi, was gathered.
The legal proceedings against the four accused have accordingly been taken forward as per law. The final chargesheet have been produced before the Ld. Court of 3rd Additional Munsiff JMIC Jammu against the accused persons namely Manager Amrik Singh Sambyal and Mohan Chander Joshi (now expired). The court have also been requested to initiate proceedings U/S 512 Cr.P.C against the two absconding accused persons namely Vijay Kumar Sharma and Col. Tirpath Singh Bhan.
