Financial dispute dominates allegations, court grants bail to Srinagar eye surgeon

Jammu, June 6: A Fast Track Court in Jammu has granted bail to Srinagar-based eye surgeon in a case registered at Police Station Channi Himmat involving allegations of deceitful sexual intercourse, cheating, criminal intimidation, forgery and assault.
Presiding Officer Fast Track Court Jammu, Amarjeet Singh Langeh, allowed the bail application after observing that the case, in essence, appeared to be predominantly marked by a financial dispute between the petitioner and the complainant.
The petitioner, through counsel Advocate Aftab Malik, pleaded that he was the founder of Eye Centre and that the complainant had worked in his eye centre. He alleged that she had committed financial irregularities and siphoned off around Rs 2.50 crore, following which he had filed a complaint and a civil suit for recovery before the court at Srinagar.
The prosecution, represented by APP Ajay Dogra, opposed the bail plea, contending that the allegations were serious, investigation was at an initial stage and release of the accused could hamper the probe. Advocates Parveen Kapahi and K.K. Pathan, appearing for the complainant, also opposed the application.
The complainant had alleged that the accused prepared a fake Nikaah Nama and memorandum of agreement and, on the basis of those documents, cohabited with her and established sexual relations by deceitful means. She further alleged that he had extorted more than Rs one crore from her.
The Court, however, noted that no Nikaah Nama or memorandum of agreement could be procured by the Investigating Officer, nor could the complainant produce such documents before the investigating agency. It also observed that the complainant had failed to provide account details or documents relating to the alleged business transactions. (JNF)
