Around one dozen 'fishy' orders issued by MD Khan kept in abeyance by APD

srinagar, Sept 10: Around one dozen government orders and administrative approvals issued during the tenure of former Commissioner Secretary, Agriculture Production Department (APD) Mohammad Mehraj-ud-din Khan have been ordered to be kept in bay by his successor.
Secretary APD, Manzoor Ahmad Lone issued a government order on September 7, 2018 asking for keeping in abeyance the orders as well as administrative approvals issued during Khan's tenure. According to the order as many as 11 government orders as well as administrative approvals have been nullified by Secretary APD.
The government order issued by Lone also makes a mention of the references according to which the orders and administrative approvals were given the green signal by the former Commissioner Secretary APD. The order said that the previous orders as well as administrative approvals have been issued without approval of the competent authority.
"It is hereby ordered that the following government orders issued/administrative approvals conveyed to various Directorates of Agriculture Production Department concerning transfers/elevations are hereby rescinded abintio as the same have been issued without the approval of the competent authority," reads the government order number 248-Agri of 2018 dated 07-09-2018.
The order further reads that accordingly all the concerned Heads of Departments are directed to maintain the status quo ante in respect of the transfers and postings of the concerned officers/officials. The order has been issued under endorsement number Agri/Gaz/Genl/174/2018.
The government orders rescinded by virtue of the latest order are 184-Agri of 2018 dated 06-07-2018, 188-Agri of 2018 dated 10-07-2018, 189-Agri of 2018 dated 10-07-2018, 190-Agri of 2018 dated 11-07-2018, 197-Agri of 2018 dated 18-07-2018, 207-Agri of 2018 dated 25-07-2018, 210-Agri of 2018 dated 30-07-2018, 212-Agri of 2018 dated 31-07-2018, 214-Agri of 2018 dated 31-07-2018, 220-Agri of 2018 dated 07-08-2018 and 222-Agri of 2018 dated 07-08-2018.
It would be in place to mention here that most of the orders issued during the tenure of Khan came under the scanner and were doubted since allegations came to the fore that money factor was involved in the issuance of same. Despite being shifted to Department of ARI & Trainings from APD, Khan continued to issue orders in his earlier department.
Khurshid Ahmad Ganai, advisor to Governor Satya Pal Malik had asked the officers to prepare a list of the orders that have been issued in the Department of Agriculture and its allied branches ever since the Governor's Rule was imposed in Jammu & Kashmir. Khan was the Commissioner Secretary APD ever since Jammu & Kashmir came under the Governor's Rule.
Pertinently, Crime Branch of Jammu & Kashmir Police lodged an FIR against Khan and arrested him on September 1 after a complaint that he has changed his date of birth. Khan was arrested after it surfaced that the bureaucrat had resorting to a change in his date of birth in his service records. The change in the date of birth would have meant that Khan would retire in November 2021 instead of November 2018.
A spokesman of Crime Branch said that it received a communication from government through General Administration Department (GAD) stating that as per the available records with the GAD the date of birth of Khan, Commissioner/Secretary, ARI and Trainings Department is 09-11-1958 (Ninth November, Nineteen Hundred fifty Eight).
"The government had to issue a notification with regard to the retirement of the said officer which is due on November 2018. Accordingly the officer was asked to submit his original Service-Book and date of birth certificate vide GAD O.M. dated 26-12-2017 followed by reminders, but despite multiple reminders the officer did not furnish the requisite records," said spokesman.
The spokesman said that on the basis of available records, the competent authority has approved notification of his date of retirement as 30-11-2018 (Thirtieth November, Two Thousand Eighteen). Later on the officer submitted his original service book in response to GAD communication No: GAD (Legal) F-78/2017 dated 8-3-2018.
"During the perusal of the service records it revealed/reflected that the date of birth has been mentioned by Khan as 9-11-1961 (Ninth November, Nineteen Hundred Sixty One) which is contradictory. In view of the contradictory date of birth the matter was referred to the Director Forensic Science Laboratory by GAD for examination," said the spokesman.
The spokesman said that FSL expert in its report vide No. 148-Doc dated 27-8-2018 opined that the first page of the original service-book has been inserted at a later stage and the provisional certificate in the original service-book has been pasted on the typed certificate of Sher-i-Kashmir University of Agricultural Sciences and Technology.
"The accused dishonestly and fraudulently has thus resorted to change of his date of birth and the records on the service book thereof, with mala-fide intention to enhance his service period by about three years," said the spokesman.
The spokesman said that case FIR No. 37/2018 under sections 420, 468 and 471 Ranbir Penal Code (RPC) has been registered at police station Crime Branch Kashmir and investigation taken up. The accused was arrested on 31-8-2018 who is kept in the custody of Crime Branch Kashmir.
