GMC PIO put on penalty notice for continued absence

Srinagar, Dec 6: The State Information Commission (SIC) has issued penalty notice against the designated Public Information Officer (PIO) of Govt Medical College (GMC) Srinagar for remaining absent during several hearings before the Commission. The designated PIO who is also the Personal Officer of GMC Srinagar has been asked to respond to the show cause notice within two weeks from issuance of the notice.
Details available with Early Times reveal that an RTI application dated 20.03.2018 was filed by one Junaid Nazir a resident of Shaheed Gunj Srinagar seeking information from the PIO Government Medical College (GMC), Srinagar regarding details of employees working in Transport Section of (GMC) and the details about total number of vehicles in (GMC).
On failure of PIO to provide information within the specified period, the appellant filed First Appeal on 25.04.2018 submitting that no information has been provided by the PIO and praying for furnishing of information to the appellant without further loss of time. The First Appeal was not disposed of by the GMC's First Appellate Authority (FAA) within the statutory period forcing the appellant to file 2nd appeal before the State Information Commission (SIC) on 01.08.2018.
The appeal came up for hearing before the SIC on 24.10.2018. Nobody appeared before Commission on the said date of hearing. The hearing was adjourned with a direction to PIO to provide information as sought by the appellant within a period of two weeks and also to file counter statement to the 2nd appeal with an advance copy to the appellant by or before the next date of hearing.The appeal again came up for hearing before SIC Srinagar on 26.11.2018. Both the appellant as well as the respondent PIO did not attend the hearing.
On 26.11.2018, the SIC held: "The PIO has also failed to file any counter statement. In view of the continued absence of the parties during the consecutive hearings held by the Commission, the appeal is disposed of with a direction to the PIO to provide complete information to the appellant within a period of two 3 weeks from the date of receipt of this order. The registry is also directed to issue a show cause notice to the PIO directing him to explain as to why penalty proceedings shall not be initiated against him for his failure to furnish information to the appellant within the period specified under Section 7(1) of the J&K RTI Act. The PIO shall be directed to file his reply within a period of 15 days from the date of issue of the notice by the registry. The appeal shall stand disposed of. However, the penalty proceedings against the PIO GMC Srinagar shall continue "
