Jammu, Nov 3 : Principal sessions judge, Poonch, Jaffer Hussain Beigh has acquitted Mohd Bashir and Zahir Abass alias Gulla, both residents of Mastandhara, and Mohammad Iqbal alias Hamza of Marhote in Surankote, Poonch, who were facing trial for the last 9 years in the murder of a Sub-Inspector after the prosecution failed. The case arises out of a report received through reliable source on 7.8.2004 at 5.45 am that some ISI-backed militants had shot dead retired SI Mohammad Bashir at Mastandhara on the night of August 6, 2004. On receiving this information, FIR No 127/2004 for commission of offence under sections 302, 121 and123 read with section 120-B of RPC and sections 7/25, 26/27 of Arms Act was registered at Police Station, Surankote. During the course of investigation vide Police Headquarter Order No 3792/2004 Dated November 21, 2004 the investigation was transferred to Crime Branch of state police. After the completion of investigation, challan was presented in the court of law. The judge, after hearing both the sides, observed that when there is neither direct nor indirect evidence against the accused, judicial process cannot be issued in the instant case against them as the prosecution has not succeeded in proving the guilt of the accused persons. With these observations, the court acquitted all the accused from the charges. |
