Controversy over beef ban in J&K assumes new dimensions

The controversy over High Court order banning slaughter of bovine cattle and consumption of beef in Jammu and Kashmir shows no sign of ending.The controversy would have ended had not political parties,politicians taken a diverse stand on the issue which has raised the level of regional passions.While one set of people,most of them politicians from the valley,have started supporting amendment to the law that imposes ban on slaughter of bovine animal and consumption of beef,the other set of people and political leaders belonging to the region of Jammu continue to oppose any amendment and any discussion in the State Legislature. Apart from this the State has been gripped by a new controversy when the Government moved Additional Advocate General.Mahesh Sharma,on charge of his failure to defend the writ petition filed in the High Court challenging the open slaughter of bovine cattle and consumption of beef. CPI (M) leader and MLA Kulgam MY Tarigami on Friday submitted a Private Member's Bill to the J&K Legislative Assembly Secretariat seeking repeal of Section 298-A, B, C and D of Ranbir Penal Code (RPC), which criminalise the sale and consumption of beef in the State.
Tarigami has said section 298-A, 298-B, 298-C and 298-D of Ranbir Penal Code fall under the classification of offences relating to religion and violate the constitutional guaranteed fundamental rights of the personal life, freedom and liberty of the citizens of Jammu and Kashmir State and amounts to the unwarranted interference to the inalienable rights of the State subject, moreover, is not constitutionally valid piece of legislation."The present 'Bill' seeks to delete Section 298-A, 298-B, 298-C and 298-D of State's Ranbir Penal Code, Samvat, 1989 and corresponding provision of Code of Criminal Procedure Samvat, 1989, as it is de-hors and violative of the basic structure of the Constitution and doesn't qualify the ingredients of constitutionally valid law," he said. Meanwhile, BJP MLA also moved a resolution today in the Assembly demanding capital punishment for those found slaughtering the bovine animal in the State.BJP MLA from Nowshera assembly constituency Ravinder Raina has moved a resolution in the Assembly in which he has asked for a complete ban on cow slaughter and sale of beef as per the directions passed by the High court."Those who are found guilty should be awarded capital punishment" the resolution read.
The State is heading for facing a new political and security instability of the type that Jammu and Kashmir had witnessed during 2008 when the regional passions were kicked up following Government's decision to transfer land to Amarnath Shrine Board for building facilities for pilgrims at Baltal.At that time a section of traders and political parties had threatened to launch economic blockade on Kashmir,However,economic blockade was never implemented because of firm steps taken by the Government and the Army.This time too the VHP has threatened of economic blockade to Kashmir if the anti-beef bill is taken up for discussion in the ensuing session of the State Legislature.However,this threat of economic blockade has found bitter reaction in the Kashmir valley where traders have announced that they would have no business deals with traders in Jammu.
Traders in Kashmir valley have berated the BJP-PDP coalition Government for having let loose VHP goons for issuing economic blockade threats and have asked the BJP and PDP leadership to clear their stand on the issue.Well the Court order banning slaughter and consumption of beef has evoked reactions on regional basis.It is time for the State Legislature to evolve a via media so that tempers of people and political leaders were not allowed to get ruffled which had the potential of kicking up fresh regional tension. Let the law remain unchanged and let the century old practices too remain in tact.It will be in the interest of peace and political stability in the State if the High Court finds a way out of the imbroglio failing which the State may face fresh political controversy which could lead to instability.
