JAMMU, Dec 14: Full Bench of State Accountability Commission headed by its Chairperson Chief Justice (Retd) B.A. Khan and Members Justice (Retd) J.P. Singh and Justice (Retd) B.A. Kirmani in a significant order in the open court issued notices to the Commissioner/Secretary General Administration Department, J&K and Commissioner/Secretary Public Works Department (R&B), J&K asking them to inform the Commission on the next date of hearing as to what action has been taken on receipt of the representation dated November, 21, 2017 made by the complainant Sukesh C. Khajuria a Social Activist of Jammu, amongst others to the Minister for Public Works Nayeem Akhter seeking time bound enquiry by a sitting High Court Judge into the alleged telephonic conversation between Former MD JKPCC and one of his subordinates which went viral on social media.
After hearing Advocates appearing for the complainant Sukesh C. Khajuria, the Full Bench of the SAC headed by its Chairperson directed the filing of the Action Taken Report by the Secretaries GAD and PWD on or before February, 8, 2018.
From the leaked conversation it came to light that the Former MD JKPCC alongwith one of his subordinates was fixing a deal to come out of the Vigilance net and in this regard the Former MDwas issuing directions to his subordinate to collect money for further disbursement to the officers of the Vigilance in order to get a safe passage.
The contents of the leaked conversation disclose the sorry state of affairs in JKPCC and further the leaked conversation show as to how the Former MD of JKPCC was trying to strike a deal with officers of SVO by offering illegal gratification.
Former MD JKPCC was expected to maintain absolute integrity and decent standard of conduct as a public servant but in the leaked conversation it is crystal clear that he has crossed all the limits of decency and has been caught establishing contacts and bribing the officers of the SVO for a safe passage.
Advocate submitted that the Former MD JKPCC directed his subordinate to arrange Rs.5.00 lacs from Jammu and he himself will manage Rs.5.00 lacs from Srinagar for its further disbursement to the officers of Vigilance and this is clearly emanating from the leaked conversation.
Advocate further stated that the entire leaked conversation puts a big question mark on the repute/integrity and credibility of the State Vigilance Organization as the allegations of fixing the top vigilance officers is time and again repeated in the leaked conversation as the Former MD time and again talks of establishing contact with the top man in the Vigilance.
After considering the submissions, the Full Bench of the SAC further directed the filing of the Action Taken Report by the Secretaries GAD and PWD on or before February, 8, 2018
