Court acquits cop after prosecution failed to prove case against him

JAMMU, June 2: Principal Sessions Judge Bhaderwah M K Sharma acquitted Tariq Hussain S/O Ghulam Rasool R/O Shaqua, Chilli Balla, Tehsil Gandoh after prosecution failed to prove that he killed Khalid Hamid who was instrumental in killing his militant brother with the help of HM militants.
During the trial some accused were eliminated by the security forces in encounter. It is a case of murder of one Khalid Hamid S/O Ghulam Hussain R/O Shikoh, Chilli Bala Tehsil Gandoh (hereinafter referred to as 'deceased'). The accused Tariq worked as SPO in J&K Police, whose brother Imtiaz Ahmed was an active militant operating in Bhalessa area, who was killed in an encounter with the security forces.
The accused suspected involvement of deceased in elimination of his brother and was, therefore, nursing a grudge with the deceased. It is alleged that Tariq conspired with the other accused, who were terrorists to eliminate the deceased and in pursuance of this conspiracy, the accused gave his service rifle AK-47 to the other accused persons, who on 17-9-2009, with common criminal intention fired upon the deceased with the service rifle of the accused from the window of the kitchen, while the deceased was having his dinner with his family in the kitchen of his house, who died on spot.
On receipt of information police station Gandoh registered FIR no.77/2009 for the commission of offences under sections 302 RPC and 7/27 Arms Act.
Principal Sessions Judge Bhaderwah after hearing both the sides observed that the circumstances alleged by the prosecution against the accused do not form a chain of events leading to the irresistible conclusion that the guilt is proved. The judge observed that prosecution case has lost credibility on account of unfair and faulty investigation.
