DB issues directives in petition regarding dearth of staff in J&K Courts

JAMMU, June 2: A petition has been filed by Joginder Singh, Bench Secretary of High Court regarding dearth of staff at various level (i.e.) High Court and District Courts, Pay Anomaly in respect of officers and staff and promotional avenues to Law Graduate Readers of the High Court. A division bench of High Court comprising Justice Dhiraj Singh Thakur and Justice Sanjeev Kumar after hearing Joginder and Satinder Singh Joint Registrar, allowed the application filed by J&K High Court Personal Staff Association to intervene in the matter.
The division bench after hearing both the sides observed that in terms of order dated 23-5-2018, respondents have filed affidavits indicating there-in the outcome of the meeting that was held on 20-3-2018 in the office chamber of the Registrar General. The affidavit filed by respondent Commissioner/Secretary Law indicates that in as many as nine different agenda items were discussed and some decisions were taken.
The court observed that from a perusal of the affidavits filed, it is apparent that no final decision in the matter could be taken due to the failure on part of Principal Secretary, General Administration Department to participate in the aforesaid meeting. It observed that decision on all the nine items taken up for discussion in the meeting on 20-03-2018 is required to be taken by the respondents.
The division bench directed Commissioner/Secretary Law and Principal Secretary, General Administration Department to file separate affidavits indicating clearly as to what steps they have taken to take final decision on nine agenda items which were discussed in the meeting held on 20-03-2018, convened pursuant to the directions passed by this Court on 27-02-2018. It granted four weeks to senior AAG to file requisite affidavits with copy in advance to the opposite side as also the intervener.
