Jammu, Aug 24: In a Public Interest Litigation filed by Jagdish Chander Gupta to highlight the illegal encroachments by the shopkeepers and other unknown persons in the JDA Shopping Complex, Mohalla Old Hospital Road, Near City Chowk, Jammu and also in the area adjoining the same, Division Bench of the State High Court Comprising Justice Dhiraj Singh Thakur and Justice Sanjay Gupta after hearing Adv Ajay Sharma for the PIL directed JMC to file status report showing what action has been taken against the shopkeepers who have not removed the encroachments.
Division Bench observed that Status report has been filed on behalf of the Municipal Corporation, Jammu, wherein it is stated that during the anti-encroachment drive number of material, Rehris, hoarding, banners, counters etc have been seized. It is further stated that as many as 461 notices have been issued to the shopkeepers, who had extended their shops beyond shutter limits. It is stated that 287 shopkeepers have removed the encroachments and carried on their business within the limits of their shops.
DB further observed that in regard to others, it is stated that 10 shops have been issued final notices and in case they did not remove the encroachment within ten days, action will be followed by sealing of their shops. Upon this Division Bench directed JMC to file status report regarding the action taken by the Municipality.
DB also directed Jammu Municipal Corporation, to reflect the number of Rehris seized and dumped in their dump-yard in next status report. This shall also help the Court to monitor the progress of seizure of illegally operating Rehris in future.
