Jammu, Aug 25: SOS International - An Organization for PoK (Pakistan occupied Kashmir) Displaced Persons, yesterday moved an application for impleadment in the ongoing Writ Petition filed in the Supreme Court of India in the year 2014 with respect to constitutional sanctity of Article 35 - A, which came into force in the year 1954 by Presidential Order.
In its intervention application filed by Chairman of S. O. S. International, Rajiv Chuni, the applicant has urged the Court to consider the plight of the PoK DPs who have been victim then and now also.
The applicant has drawn the kind attention of the Court on the petty relief package sanctioned by the Central Government, benefit of which cannot be taken by those who don't possess domicile of J&K. The Chairman of S. O. S. International also highlighted the plight of 12 Lakhs persons represented by the applicant at different junctures and of approximately more than 1.5 lakh families who are still residing in transit camps and living deplorable/miserable lives.
The applicant also stated that PoK DPs who got settled in the states other than J&K could not take the benefit of the package which the applicant got sanctioned from the Government of India due to embargo/restrictions which is a glaring example of clear infringement of the rights of the class.
The applicant Rajiv Chuni urged in its application that,"India a sovereign democratic republic" and any kind of discrimination with its people is a direct attack on the sovereignty, which has no place in the benign Constitution and a flagrant breach of one's rights.
