17 years RI in kidnapping, rape of minor

Jammu, Aug 30: Presiding Officer Fast Track Court Haq Nawaz Zargar today awarded 17 years rigorous imprisonment to Surinder Kumar for kidnapping and committing rape with minor.
According to the complainant, accused Surinder Kumar had kidnapped the victim (name with held) who was minor and had taken her to some unknown place. It had been further mentioned in the complaint that the other accused persons had provided motorcycle to the accused Surinder Kumar for commission of the crime. It had been further stated in the report that till date they were searching for the victim as such they were late in filling the report. On the basis of this report FIR under section 363/109 RPC was lodged. After the commencement of the investigation, statement of the witnesses under 161 were recorded and offences under section 363/109 RPC came to be established against the accused person. After completion of investigation challan was presented in the Court.
Presiding Officer Fast Track Court after hearing both the sides observed that convict named Surinder Kumar, S/o Jagdish Raj, R/o Raharian, Tehsil & District Samba, is sentenced to undergo rigorous imprisonment for ten years and to pay fine of Rs 50000/- (Fifty Thousand only) for the commission of offence under section 376 RPC. In default of payment of fine, he shall further undergo simple imprisonment for six months. He shall further sentenced to undergo rigorous imprisonment for a period of seven years and to pay fine of Rs. 30,000/- for commission of offence under section 363 RPC. In default of payment of fine, he shall further undergo simple imprisonment for 03 months. The fine, if deposited by the convict shall be paid to the minor victim. Both the sentences shall run concurrently. The period of detention already undergone by the convict during inquiry, investigation and trial of this case shall be set off.
