HC seeks status of trial against erring official
Rs 45 Crore PHE scam

Srinagar, Sept 24: The State High Court today sought status with regard to the trial before special anti-corruption court against officers and officials allegedly involved in embezzlement of public money meant for providing potable water scheme to people in Handwara in north Kashmir.
Hearing a Public Interest Litigation, a Division Bench of Chief Justice Gita Mittal and Justice Rashid Ali Dar sought the status after State counsel informed the court that challan against the erring officials involved in the scam was pending before the court of special court anti corruption Baramulla.
The court on August 29 had directed that in case the challan has been submitted before the court of law, then the progress and stage of the challan be also submitted to the court along with the details of those persons who are involved in the scam.
The court also sought information regarding the funds which have been received by the PHE Division, Handwara for providing safe drinking water to the people living in hilly areas since 2010; the details of the Schemes towards which these funds were released; the prescribed dates of completion of the Schemes; Steps which were actually taken for execution of the Schemes and the dates thereof; Breakup of the expenses incurred and disbursed for the works undertaken; Names of the officials not below the ranks of the Executive Engineers and Chief Engineer responsible for execution of the Schemes concerned; the details of the FIR(s) which was registered by the Police and the status thereof.
The government has been also directed to inform the Court as to whether any disciplinary proceeding have been initiated against the officials against whom culpability has been attributed for the acts of omission and commission with regard to the funds and Schemes
Approximately Rs 45 crores have been swindled and the fact has been admitted in its reply by the government.
