Engaged on temporary basis, JE becomes MD SICOP

Jammu, Nov 14: A junior engineer (JE), who was engaged on temporary basis for three months around two decades ago, has reached to the post of Managing Director of a public sector undertaking and may be elevated further if things remain in his favour.
It was January 1998 when Jaswinder Singh joined as JE for three months in J&K Small Scale Development Corporation Ltd (SICOP) a government owned company, sources informed Early Times.
"His appointment was purely on temporary basis and the contract expired on April 15, 1998. But mysteriously, his service was regularized five days after his contract expired, that too without any recruitment process", sources said.
They said that it is an accepted principle of law that the exercise of power by an authority cannot be unguided as the constitution prescribes the limitation of each and every authority. "Provisions of SICOP staff service rules 1977 do not provide for any temporary appointment of any JE in the organization. The service rules were clearly and brazenly violated under rule of Dr Farooq Abdullah when Jaswinder Singh was engaged", sources added.
They said that an appointment of Jaswinder Singh was made vide order endorsement No: SICOP/Admn/185 dated 15/1/1998 which has been stated to be valid for three months from the date of issue of the said order. "Further vide order No: 39 Admn of 1998 dated: 20/4/1998 sanction was accorded to the regularization of Jaswinder Singh against the available vacancy of JE", said the sources, adding that both the orders were not only illegal but against the rules applicable to the corporation as well as applicable to the state employees.
"The basic order, subsequent regularization of Singh and his consequent promotions have been made in violation of rules", sources said and added that with the blessing of some bureaucrats at the helm, Singh was recently appointed as Managing Director of SICOP.
