SIC reprimands FAA, PIO of DSEK for withholding info

Srinagar, Nov 18: The State Information Commission (SIC) has once again reprimanded the First Appellate Authority (FAA) and Public Information Officer (PIO) of Directorate of School Education Kashmir (DSEK) for deliberately withholding an information sought under RTI Act by an information seeker. Commission has directed the PIO to provide information to RTI applicant and has castigated his and FFAs role in dealing with RTI related applications and appeals.
Details available with Early Times reveal that an application dated 19-02-2018 was filed by one Ghulam Muhammad Ganai R/O Akhran Kulgam with Public Information Officer (PIO) , Directorate of School Education Kashmir (DSEK), Srinagar seeking information on 11 points. When PIO failed to provide any information to Ganai, he filed first appeal before Fist Appellate Authority (FAA) in the office of Director School Education, Kashmir (DSEK) on 28-03-2018. The appellant feeling aggrieved again filed second appeal before the State Information Commission (SIC) on 04-07-2018 submitting that neither any information was provided to him by the PIO nor the first appeal was disposed of by the Joint Director DSEK who is the designated FAA.
The appeal came up for hearing before SIC once again on 17-10-2018. The appellant Ghulam Mohammad Ganai was present in person. The PIO of DSEK was not present during the hearing. Jehangir Ahmad, APIO office of the CEO, Anantnag and Ajaz Ahmad, APIO in CEO, Kulgam were present. Both the APIOs submitted that they have furnished the information relating to their offices to the DSEK. The appellant again reiterated that he has not received any information including the part information claimed to have been furnished by PIO, Directorate of School Education, Kashmir on 10-05-2018.
The SIC while disposing off the appeal passes a direction to the PIO, Directorate of School Education, Kashmir to provide complete information to the appellant covering all points of the RTI request dated 19-02-2018 filed by the appellant within a period of two weeks from the date of receipt of this order.
