Procurement of fabricated lavatories in Doda

Doda, Nov 28: The State Information Commission (SIC) has directed Assistant Commissioner Development (ACD) Doda to provide details about procurement of fabricated lavatory to an information seeker under RTI Act. This information was earlier denied under RTI which forced information seeker to file an appeal before SIC.
Details available with Early Times reveal that an RTI application was filed one Haq Nawaz Nehru R/O Doda on 13.03.2018 before PIO/ACD Doda seeking information with regard to procurement of fabricated lavatories and other related information. As PIO failed to provide the requisite information within the stipulated time period, the appellant filed First Appeal before the FAA/Director, Rural Development Department, Jammu on 28.04.2018. The said First Appeal was disposed of by the FAA on 25.05.2018 with directions to the PIO/AC (D), Doda to provide the requisite information to the appellant within seven days free of cost from the date of issuance of the order.
Aggrieved by this order of the FAA, the appellant filed second appeal on 16.07.2018 (admitted on 30.07.2018) before the State Information Commission (SIC) contending there under that no information has been provided to him by the PIO even after the orders of the FAA.
The appeal came up for hearing before State Information Commission (SIC) on 23.10.2018. Director RDD Jammu / FAA Rehana Batul, KAS, attended the hearing through Video Conferencing from Jammu office of the Commission. However, the appellant as well as the PIO/ACD, Doda did not attend. The FAA furnished a copy of communication dated: 12.10.2018 of the Assistant Commissioner (Development), Doda wherein Commission (SIC) was informed that ACD Doda has never procured the fabricated Latrines, nor called for tenders for the same.
The SIC held : "The PIO/AC (D), Doda has already replied to the RTI request of the appellant vide his communication dated: 12.10.2018, but the receipt of the same could not be ascertained because of the absence of the appellant in the hearing. The appeal is accordingly disposed of with a direction to the PIO/ACD, Doda to resend the information to the appellant within a period of 02 weeks from the date of receipt of this order "
