| Petitioner not to be replaced by any other contractual appointee: HC | | | Early Times Report
JAMMU, Jan 17: In a petition filed by Ravi Kumar who came to be appointed as X-Ray Technician purely on contractual basis for a period of one year under National Health Mission vide order dated 13.02.2008 and initially adjusted at Community Health Centre, Gool in District Ramban, it is stated that petitioner is continuously performing his duties as X-Ray Technician on contractual basis without any interruption to the entire satisfaction of his superiors.
The petitioner is aggrieved of the issuance of impugned Notification No.03 of 2018 dated 19-07-2018 passed by respondent No. 4 inviting application from suitable candidates for hiring of contractual staff under National Health Mission in District Poonch including the post of X- Ray Technician for CHC Mandi for which the petitioner is already working on contractual basis. It is further stated that petitioner made representation against the issuance of impugned Notification against which the petitioner is already working. The respondent No.3 while appreciating and admitting the representation of the petitioner directed the respondent No.4 to withdraw the impugned notification qua the petitioner but till date no action has been taken by the respondent No.4 who is contemplating to replace the services of the petitioner with another contractual employee.
Justice Sanjau Gupta after hearing Adv Sanjay Sharma appearing for the petitioner issued notice to respondents and ordered that subject to objections from other side and till next date of hearing before the Bench, respondents shall not replace the petitioner by any other contractual appointee. |
