| DB seeks status report on repair of Tawi Bridge | | | Early Times Report
Jammu, Feb 1: In a suo-moto PIL on a news item titled 'Gujjar Basti: Offenders including officials involved in 4th Tawi Bridge damage roam free' in which earlier Division Bench directed respondents to ensure that damage to the Tawi Bridge is repaired at the earliest, a Division Bench comprising Chief Justice Gita Mittal and Justice Tashi Rabstan observed that respondents informed the Court that the damages to the Tawi Bridge have been repaired by the Public Works Department.
Division Bench directed respondents to file status report before next date of hearing. Division Bench also appointed Adv Rajneesh as Amicus Curie, who shall assist the Court in the matter.
It is worthwhile to mention here that earlier Division Bench observed that This report bring to us the manner in which parapet of Tawi Bridge has been broken to provide complete unauthorized passage to illegal encroachments which have been effected in gross violation of the guidelines of the Supreme Court as well as the Roads and Bridges Act. Such intervention on bridges is completely impermissible. The act of damaging the parapet tantamount to cause damage to the public property and would be penal offence as well. Copy of the above report is taken on record.
DB further observed that the matter is of an extremely serious nature, inasmuch as not only the property is being damaged, but also, damage is effected to facilitate the encroachments on public land. No person would be allowed to encroach upon the public property for private purpose. Certainly, the action in damaging the bridge to provide illegal access to such encroachment is a crime of the worst nature. This matter deserves cognizance in public interest. DB also directed respondents to ensure that damage to the Tawi Bridge is repaired at the earliest. |
