Jammu, Feb 1: In a Public Interest Litigation filed by Adv Sumit Nayyar seeking respondents to develop/improve the tourist infrastructural facilities for the Patnitop-Mantalai-SudhMahadev including temples which attracts a large number of tourists every year both in summer and winter season and to take effective measures as expeditiously as possible, a Division Bench of State High Court Comprising Chief Justice Gita Mittal and Justice Tashi Rabstan, directed respondents to file latest position with regard to the permission for construction of Convention Centre at Patnitop be placed before us on the next date of hearing. Time is also sought by FA.Natnoo, AAG to file the monthly status reports regarding the development of Mantalai and Sudhmahadev in terms of order dated 24th December, 2018.
DB also made it clear that the order dated 24th December, 2018 shall be strictly complied with by the respondents.
Division Bench observed that Pursuant to our order dated 27th December, 2018, a status report stands filed by respondent No.3 i.e., Secretary to Government, Tourism Department, J&K thereby informing us that 112th meeting of the Forest Advisory Committee was held under the Chairmanship of the Chief Secretary, J&K Government wherein the issue of permitting the use of 0.175 hectares of forest land for construction of Convention Centre at Patnitop was taken up for consideration. The minutes of the meeting and the Status Report refers to orders passed in IA No. 401 in case No.202/1995 titled Godvarman vs. Union of India by the Supreme Court which records the statement of Advocate General of this State that no further construction or conversion will be permitted at Patnitop till after the ecological balance has been restored. In view of the above, the proposal stands deferred. The Forest Advisory Committee has proposed to file an application seeking permission of the Supreme Court to construct the Convention Centre at Patnitop.
