Jammu, Feb 11: In an extraordinary order, State Information Commission (SIC) has directed Directorate of Health Services Jammu that an application filed under Right to Information Act (RTI) be treated as a complaint as many employees of the health department were getting 2 ½ month extra salary every year while as they do not perform the duties on Sundays and gazetted holidays. This matter was brought into notice of commission through an RTI application filed by a resident of Jammu.
Details available with Early Times reveal that one Subash Chander Tidyal R/O Janipur Jammu on 16.04.2018 filed an application before the PIO/Deputy Director, Health Services, Jammu seeking details with regard to attendance of employees getting 2 ½ months extra salary. The PIO responded to the said RTI request vide his communication dated: 16.05.2018. Subsequently, the appellant filed First Appeal on 19.06.2018 with the Director, Health Services, Jammu (DHSJ) who is the First Appellate Authority (FAA) .
Aggrieved with the response of PIO / FAA Finally, the Tidyal filed Second Appeal before the State Information Commission (SIC).
In the said rejoinder, the appellant pointed out certain employees who are being paid two and half day salary without marking their attendance and without performing duties on Sundays and holidays.
State Information Commissioner M A Mir while issuing the orders said that it is for the employer to ensure that his employees are attending the duties as per the duty roaster and that only such employees are given additional salary/emoluments who work on holidays and Sundays as well. Information Commissioner in his order said that Commission is not the appropriate authority to go into service matters or issues which are within the management domain of concerned public authority. But he disposed off the appeal with advice to DHS to ensure that laid rules in this regard were adhered to.
