CBI, Taxes Deptt conduct surprise check at Rly Station

JAMMU, Mar 26: CBI and State Taxes Department conducted joint surprise check at Railway Station, Jammu, Attachment of properties of GSTR 3B non-filers put in motion.
After busting the fake GST firms racket under operation from New Delhi, the State Taxes Department, Jammu has issued the demand order of Rs.52 Lakh against the GST firm in operation. This is sequel to the interception of vehicle on 4th March, 2019 bearing no.RJ09GB-2622, carrying items worth Rs.52 Lakh to the State. All the tax invoices of goods in vehicle were found to be issued by Mahima Enterprises, A.R. Electricals and Mahima Garments Export under proprietorship of Rajeev Bhatia.
The goods were under transshipment to the State through aforementioned vehicle and were to be handed over to Mahima Trade Mart, P.K. Pal Traders, Santosh Traders, Kathua, Ravish Traders, Kathua and Khan Enterprises. On scrutiny it was found that none of the above are located in J&K State. The vehicle is under custody of the State Taxes Department and shall be eligible for release only after deposition of Rs.52 lacs as State and Central tax and penalty. Meanwhile the State Taxes Department has taken up the matter with the Principal Director General, Central Excise (Intelligen-ce), New Delhi forwarding full details of the case, names of the firms, their GSTIN numbers for ordering an in depth enquiry to arrest the whole fake firms racket in operation with intention to evade the GST.
Meanwhile the State Taxes Department conducted a joint surprise at Railway Station, Jammu and seized 85 consignments of cloth items destined to Jammu through Ahmedabad Express. It was found that all the consignments were being transshipped to the State without proper e-way bills. The action has been taken by the State Taxes Department with the CBI to ensure plucking of GST leakage through Railways being the Central Authority. The State Taxes Department has forwarded the detailed report regarding the 85 consignments being transshipped to J&K without e-way bill to the CBI alongwith the details of seizure of goods worth Rs.25 lacs made at Udhampur on 10th February, 2019 and seizure of goods worth Rs.1 crore made at Railway Station, Jammu on 13th & 14th February, 2019.
The State Taxes Department on the other hand has intensified its operation against GSTR 3B return non-filers. The GSTR3B return non-filers have been identified and if they fail to file the returns by 31st March, 2019, the Department shall initiate proceedings against all such non-filers under Section 83 of the State Goods and Services Tax Act and attach their properties, goods, bank accounts for protecting the Government revenue. The department has time and again appealed all the GSTR 3B non-filers to file return on time but now the Department is mulling to take harsh measures to ensure deposition of State & Central tax collected by dealers in Government chest.
