Court rejects bail of car thief

Jammu, Apr 25: The court of Sub Judge Jammu on Thursday rejected bail application of a car thief.
According to the prosecution, one Vandana Chib lodged a complaint on 10.01.2019, saying that she had parked here car a day before in a market area. On return, she found her vehicle missing. The car was registered in the name of her father. The police registered FIR No.21/2019 for offence u/s 379 RPC, and during investigation police arrested the alleged thief.
The Sub-Judge Jammu Pawan Kumar Sharma, after hearing the senior PO Puja Nijhon observed: "I have gone through the report which does not disclose as to when the accused has been arrested. So the claim of the applicant that he had been in police custody for the last nine days is found false. I have also found that accused has not only stolen the vehicle of the complainant who happens to be her neighbour but he has also shattered the faith of the complainant.
"In my opinion, accused/applicant had more responsibility to act with his neighbour. The fact that firstly keys were stolen and then the vehicle, shows how pre-planned the whole act was committed by the accused. The fact that the vehicle is involved in other case and has been recovered by Police Station, Rajbagh Kathua in offence u/s 3/25 Arms Act also shows the design and intention of the applicant/accused. There have also been allegations against the accused about his involvement in some other cases of similar nature which shows that accused is a habitual offender."
Hence, the grant of bail would negate the ends of justice in the present case, the court added.
