ADDC Kupwara on penalty notice for failure to appear before SIC

Srinagar, May 19: As the Additional District Development Commissioner (ADDC) Kupwara who is also the designated Public Information Officer (PIO) in the office of Deputy Commissioner Kupwara (DC office) failed to attend four consecutive hearings at State Information Commission (SIC) , the Information Commissioner Mohammad Ashraf Mir while taking the issue seriously has issued a penalty show cause notice against the officer.
Details available with Early Times reveal that an RTI application dated 01-11-2018 was filed by one Fahmeeda Nabi R/O Rednag Sogam District Kupwara with Additional District Development Commissioner (ADDC) who is also the designated Public Information Officer (PIO) in the office of the Deputy Commissioner, Kupwara seeking information with regard to action taken report vis a vis letter No.DCK/SQ/AW/18/511 dated 17.07.2018.
The appeal came up for hearing before the SIC on 29.03.2019. The appellant Fehmida Nabi was represented Nazir Ahmad Mir. However, nobody appeared on behalf of the respondents (FAA and PIO) . The appellant vide her RTI application dated 01.11.2018 had sought information from PIO office of Deputy Commissioner, Kupwara relating to action taken report in respect of letter No.DCK/SQ/AW/18/511 dated 17.07.2018, wherein Assistant Commissioner (Revenue) Kupwara had sought comments along with recommendations from District Programme Officer, ICDS, Project Kupwra relating to case titled Ms Fahmeeda Nabi V/s ICDS Kupwara.
The representative of Fehmida Nabi submitted before SIC that no information has been furnished by the PIO. The hearing was adjourned and the PIO in the office of Deputy Commissioner, Kupwara was directed to provide information to the appellant within a period of 10 days from the date of receipt of interim order and also file counter statement explaining as to why the PIO in question has failed to provide information to the appellant within the specified period of 30 days.
As per directions passed by the Commission vide interim order dated 29.03.2019, the PIO in the office of Deouty Commissioner, Kupwara was directed to provide information to the appellant within a period of 10 days from the date of receipt of interim order and also file counter statement explaining as to why the PIO in question has failed to provide information to the appellant within the specified period of 30 days. The PIO neither attended the hearing nor filed counter statement as directed by the State Information Commission (SIC) vide interim order dated 29.03.2019.
The non-appearance of the PIO (ADDC Kupwara) on four consecutive hearings of the Commission despite advance notices issued by the Registry of the Commission was seriously viewed by the Commission. The appeal was disposed of with a direction to the PIO office of the Deputy Commissioner, Kupwara to provide complete information to the appellant within one week from the date of receipt of SIC's order.
"The Registry is directed to issue a show cause notice to the PIO office of Dy. Commissioner, Kupwara directing him to explain as to why penalties as envisaged under the provisions of the Act shall not be imposed upon him for his failure to provide information to the appellant within the period specified in Section-(7(1) of the J&K RTI Act, 209 and also for his failure to comply with the orders of the Commission in this appeal. He shall also be directed to file written explanation along with compliance report before the Commission within two weeks from the date of receipt of such notice "
