TADA court issues notice to Yasin Malik, others
Rubaiya abduction, IAF officers' killing

Jammu, May 21: The TADA court has sought presence of JKLF chairman Yasin Malik and his associates involved in the kidnapping of Dr. Rubaiya Sayeed and the killing of five Indian Air Force personnel in 1990.
The Presiding Officer, TADA Court, on Tuesday issued notice to Malik, Ali Mohammad Mir, Mohammad Zaman Mir, Iqbal Ahmed Gandroo, Javed Ahmed Mir, Manzoor Ahmed Sofi, Wajahat Bashir Quresi, Mehraj-ud-Din Sheikh, Showkat Ahmed Bakshi, and Saleem Nanaji.
When the matter was taken-up, Public Prosecutor CBI submitted a copy of order passed by the High Court whereby the court had dismissed the petition of the accused and vacated the stay.
The court after going through the copy of order issued notice to the accused and sought their presence on June 8.
Rubaiya, daughter of the then Union Home Minister Mufti Mohammad Sayeed was abducted when she was travelling in a mini bus from Lala Ded Hospital Srinagar to her house at Nowgam. She was taken to some unknown place by some unknown terrorists travelling in the same bus who threatened to kill her in case their illegal demands were not met with.
A case was registered on 18.09.1990 and the charge sheet was filed by CBI on 18.09.1990 under section 120-B read with section 364, 368, 109 and 34 of RPC, Section 3(1) TADA and Section 27 of Arms Act in the court of 3rd Additional Session Judge (TADA cases Jammu) against the accused.
That during the course of trial a petition dated 25.10.2008 was filed for transfer of the case to the designated court of TADA at Srinagar. Objections to the said application were filed by the CBI and after hearing both the parties the application was rejected vide order dated 20.04.2009 against the said order of trial court. The petitioners approached the High Court on 30.04.2009 and the court stayed the proceedings of the trial court.
In the killing of five IAF personnel, an FIR was registered on 25.01.1990 under sections 302/307 of RPC, 3(1) Terrorist and Descriptive Activities (Prevention) Act of 1987 and 3/25 Indian Arms Act in Police Station Saddar against the unknown accused persons.
