HC seeks SWM by-laws for Pahalgam in 3 weeks

Srinagar, July 5: The J&K High Court has sought a report regarding finalization of the model Solid Waste Management (SWM) bye-laws for Pahalgam within three weeks.
Hearing a Public Interest Litigation, a division bench of Chief Justice Gital Mittal and Justice Rashid Ali Dar, the court also sought a report regarding online applications of building permission as and the processing of the same.
As soon as the hearing of the case came up before the division bench, a report was submitted by the Court Commissioner appointed on April 10 this year.
The court ordered that copies be furnished to the counsel for the parties in the matter and for their say.
"We have not received a report regarding status of receipt of online applications of building permission as well as the processing from the respondents," the court observed and asked M A Chashoo, Additional
Advocate General, to ensure that the latest report was filed before the before the next of hearing on September 2.
"We have also not received any report regarding finalization of the model Solid Waste Management bye-laws. Report in this regard shall be positively filed within three weeks from today," the court said.
The court has already directed officials to ensure that enforcement of SWM system is in place in the state.
It has also made it clear that in so far as the permissible area was concerned, any construction would also be permitted but only in terms of the master plan and that too by the BOCA. "Therefore there is no need to file application before this court. The applications be filed before the BOCA."
