IMPARD faculty selection: Finally, file note provided under RTI

srinagar, July 9: The J&K institute of Management Public Administration and Rural Development (IMPARD) finally provided an important file note to an information seeker under RTI Act as the same was denied earlier by the Public Information Officer (PIO) and First Appellate Authority (FAA) invoking section 8 of the RTI law.
The information seeker had sought details of selection process being made by the institute for recruitment of faculty members, but he was denied access to several documents especially the vital file note. When the case came before State Information Commission (SIC) for hearing, the officers at the helm of affairs finally provided the same to information seeker
Details available with Early Times reveal that an RTI application dated 01.02.2019 was filed by one Dr Ghulam Mohammad Dar, of Bemina, Srinagar with PIO/Deputy Director, J&K IMPARD, Srinagar seeking information regarding providing of Xerox copy of the proposal/notings of the file for faculty recruitment approved by the competent authority on the basis of which advertisement notice No.02 of 2018 dated 28.11.2018 was 2 issued.
Not satisfied with the disposal of RTI application by the PIO, the appellant filed First Appeal with the FAA, Joint Director J&K IMPARD, on 07.03.2019. Dr Dar was again aggrieved by the disposal of the appeal by FAA (Joint Director) and subsequently the appellant filed the 2nd appeal before the SIC on 29.04.2019 submitting therein that in view of denial the requisite/complete information to him by the PIO on the ground of exemptions as provided under Section-8 of the J&K RTI Act, the PIO be directed to provide him the requisite information as the information sought by him does not fall within the purview of the exemption clause viz-a-viz Section-8 of the J&K RTI Act.
The appellant further submitted that the PIO be dealt with strictly as per the provisions of the J&K RTI Act for causing delay in providing him the requisite information within the prescribed time frame.
The appeal came up for hearing before the SIC on 14.06.2019. The appellant attended the hearing in person. Mushtaq Ahmad Rather, FAA/Jt Director, J&K IMPARD, Srinagar, and Tariq Ahmad Kakroo, PIO/Dy. Director, J&K IMPARD Srinagar also attended the hearing. During the proceedings, the PIO submitted that the information sought by the appellant has been provided to him on 26.03.2019. The appellant acknowledged the receipt of said information. He, however, submitted that the information provided by the PIO was incomplete and submitted that the information pertaining to note Para-15 of the file for faculty recruitment approved by the competent authority on the basis of which advertisement notice No.02 of 2018 dated 28.11.2018 was issued has not been provided to him. The PIO, during the course of hearing provided Xerox copy of the said note para to the appellant, who expressed his satisfaction on receipt of the same.
"Since the entire information as sought by the appellant through his RTI request dated 01.02.2019 has been provided to him to his entire satisfaction, nothing further remains to be adjudicated in this appeal. The appeal is accordingly disposed of without any further orders or directions," reads SIC's final order.
