ONE NATION - ONE CONSTITUTION
8/20/2019 10:26:31 PM

R.B. SURI

The Indian Republic is one now with one constitution and one Flag as a result of the abrogation of the Article 370 of the Indian Constitution made by the Indian Parliament on August 5. Prior to it the state of Jammu and Kashmir was enjoying the special status under the Indian Constitution. J&K was having its own Constitution and the Flag. Abrogation of the Article 370 of the Indian Constitution by the Indian Parliament under the able and dynamic leadership of the the Prime Minister Narender Modi is the bold decision in making the nation as one in the real sense with one Constitution and one Flag.
Article 370 of the Indian Constitution breeded the corruption, nepotism , separatism and the militancy in Jammu and Kashmir for decades together and with the abrogation of the Article 370 of the Indian Constitution by the Indian Parliament, the people of the state got the sigh of relief these days. Gone are the days when the erstwhile J&K state was enjoying the special status under the Article 370 of the Indian Constitution and the people of the rest of the country were not entitled to the buy the land in the state under the Article 35 A. Both of the Articles of the Indian Constitution stand scrapped on August 5 by the Indian Parliament which is the Supreme body of framing the laws for the country. The President of India has already given his nod to the same. Now therefore, the Kashmir centric leaders should not make the hue and cry for retaining the same as there is no fun in crying over the spilt milk. Without keeping their eye on Pakistan which is in shambles these days, they should rather rise to the occasion in their interests to develop the sympathies for the overall development of the country and the J&K UT as well. Abdullahs and Muftis who ruled the state for more than three decades and made the lives of the subjects of the state miserable are things things of the past. They remained at the helm of the affairs in the erstwhile state of Jammu and Kashmir which stands bifurcated into two UTs - Ladhakh and J&K UT by the Indian Parliament on August 5.
For the lust power in the erstwhile state of Jammu and Kashmir, Abdullahs and Muftis went on exploiting the people of the state for their vested political interests only without caring for their welfare and the overall development of the state. According to the unofficial sources more than 80000 have been killed since 1987 as against the figure of 40000+ as announced by the Union Government in the Indian Parliament. This is very unfortunate.
It was the then Prime Minister of India Pandit Jawahar Lal Nehru who was having the soft corner for the King without any crown Sheikh Mohammed Abdullah (Betaj Badshah) and was also allergic to the last Maharaja of the Dogra Kingdom Hari Singh, had opted for the insertion of the Article 370 into the Indian Constitution despite of the opposition of Sardar Patel and the founder of the Jana Sangh Dr. Shayma Prashad Mukherji. In way or the other, the then Prime Minister of India Pandit Jawahar Lal Nehru wanted to please his close friend Sheikh Mohammed Abdullah (Betaj Badshah) who had revolted against the last Maharaja of the Dogra Kingdom Hari Singh at every cost and made him as the Prime Minister of the state of Jammu and Kashmir who ruled the state up to 1953 and was imprisoned in the Kashmir conspiracy against him. As the history of the state reveals that after Sheikh's imprisonment, Bakshi Ghulam Mohammed took over the reigns of the state and he too remained as the Prime Minister of the state for some time and subsequently, the post of the Prime Minister of the state was abolished. Under the Kamraj plan, Ghulam Mohammed Sadiq was made as the Chief Minister as the head of the Indian National Congress (INC) government in the state. Subsequently, Ghulam Mohammed Sadiq was succeeded by Syed Mir Qasim of the INC who ruled the state for more than five years and was removed from the post after Indira- Sheikh Accord in 1975. For preparing the grounds for the Accord , the GOI was represented by its emissary G. Parthasarthy and the Sheikh was represented by his emissary Mohammed Afzal Baig (from NC). It is very relevant to describe here that the transfer of political power to Sheikh Mohammed Abdullah was within no minute despite of the fact that the Sheikh was not having a single MLA of his party( NC ) in the J&K Legislative Assembly at that time. By installing Sheikh Mohammed Abdullah, this decision of the then Union Government of the time was the murder of the Parliamentary Democracy in the country.
By removing Syed Mir Qasim as the Chief Minister of the state, INC lent the support of its MLAs to Sheikh Mohammed Abdullah and he continued as the Chief Minister of the state till his death in 1983. After the death of Sheikh Mohammed Abdullah, his eldest son Dr. Farooq Abdullah became the Chief Minister of the state who on his own ruled the state twice and once in coalition with the INC. After Dr. Farooq Abdullah his son Omar Abdullah ruled the state. The National Conference governed the state on the philosophy of the Dynastic Rule in the state. Both the Abdullahs and Muftis had treated the erstwhile state of Jammu and Kashmir as their Kingdom and having looted the huge money they built their big bungalows in and outside the state to pass their lives as the Kings of this sensitive state whereas the poor masses are left at the mercy of the God only As far as the experience goes they never remained serious in the overall development of the state and the welfare of its citizens but on the contrary, they preached the anti Indian feelings in the minds of the people of the state against the Union Government and had en cashed their political ambitions thereby leaving the space for getting the sympathies for Pakistan which always remained at their back every now and then. Kashmir centric leaders of the valley treated the Article 370 as a shield to spread the terrorism in the state at the instance of Pakistan. It is the hard fact the all the countrymen(132 +Crores) and the Union of India are really interested in the well being of the people of the state. These days, the entire state is put on high alert by the security forces of the country and the overall situation in the state is generally peaceful as there was no major encounter between the terrorists and the security forces in the valley during the last month which is considered as the good sign of development. All the top leaders of the PDP, NC, Panthers Party have been made under house arrests so that they may not be able to further vitiate the peaceful atmosphere in the valley and the Jammu region as well. As a precautionary measure the net services in the entire state have been curbed. Also the competent Governor Satya Pal Malik is on record as having said that not even a single bullet fire occurred in the valley after the abrogation of the Articles 370 and 35 A of the Indian Constitution. This certainly goes to his credit.
The people of the valley should treat themselves as the Indian first and think for their overall development and welfare by remaining within the ambit of the Indian Constitution. Without keeping an eye over PAKISTAN, they should live like as Indians and die in protecting the Integrity and the Sovereignty of the nation. Their ultimate future is bright in this great country where Hindus, Muslims, Sikhs, Bodh, Jains, Christians and others live together since centuries. This peculiar characteristic of the nation exists since long as it gives the shape to the country like a beautiful garden in which there are numerous beautiful flowers in it. Under the changing scenario, the people of the valley are required to change their mindsets and they should start developing the love for the country and its citizens so as to enable them to move ahead fastly. It is on record that the former Chief Ministers of the erstwhile J&K state Dr. Farooq Abdullah and Mehbooba Mufti had stated that no power on this earth can snatch the special status of J&K and the moment the special status of J&K is withdrawn, the state will be on fire and there will be a total bloodshed in the valley. Fourteen days are already over after the abrogation of the Articles Articles 370 and 35 A of the Indian Constitution made by the Indian Parliament on August 5 by the two third majority. The Governor Satya Pal is also on record as having said that not even a single bullet was fired by the security forces of the country in the valley.
Keeping all the facts as stated above in this article in view , it would be better for the Kashmir centric leaders of the valley that they should respond to the central Government measures positively otherwise they would be finished once for all as the people of the state are really fed up from them. They should behave like the good citizens of the country forgetting their past and should start thinking a fresh in light of the recent developments.
Amit Shah, while criticizing all the congress governments in the past, stated that they were terming the Article370 of the Indian Constitution as the temporary in nature and for making the same as permanent they did not do any thing positive on this score and were saying every now and then that it will go with the passage of time and were tossing this important issue for the years together for which they are answerable to the people of the country. With the abrogation of the Article 370 we can say with proud that The Nation is one with having its own Flag and the Constitution. The Constitution of Jammu and Kashmir and its flag have gone with the wind for ever after passing over of the Bill on the Reorganization of the Jammu and Kashmir state by the Indian Parliament on August 5. The country shall remain indebted to Narender Modi for ever.
