| Court rejects narco smuggler's bail | | |

JAMMU, Sept 3: Principal Sessions Judge Kathua Pawan Dev Kotwal rejected the bail application of Mohd Saleem Kumar S/o Gh Nabi Kumar R/o Mattan, Tehsil Mattan, District Anantnag from whose possession 41.600 gram poppy straw was recovered.
Principal Sessions Judge Kathua Pawan Dev Kotwal after hearing Public Prosecutor Nidhi Suman for the State whereas Adv Manjeet Singh for the accused observed that From the perusal of record, it is revealed that the applicant/accused is facing trial for the offence under sections 8/15 NDPS Act as is allegedly to have possessed 41.500 kilograms of Poppy Straw. Record further reveals that only one witness has been examined so far. The quantity of Poppy Straw allegedly recovered from the possession of the accused is though not commercial to attract embargo contained in section 37 of NDPS Act but at the same time, is a huge quantity, just less than the limit to reach commercial one.
Moreover, many material witnesses yet remain to be examined and therefore, in the totality of circumstances particularly the menace of drugs narcotics reaching an alarming situation, I am of the opinion that the applicant accused does not deserve to be released at this stage. The application is therefore, dismissed. |
