Court rejects bail of medical narco smuggler

JAMMU, Sept 6: 1st Additional Sessions Judge Jammu YP Kotwal rejected the bail application of Rohitveer Singh, S/o Krishan Singh, R/o Muzafrabad, UP, a medical narco smuggler.
According to the police case that accused was arrested in FIR No.78/2019 registered at P/S Pacca Danga, Jammu, for commission of offence under Sections 8/21/22 of NDPS Act, for recovery of 1000 Capsules of Tramadol Weighing 385*1000= 385000ML (385 GMS) from the conscious possession of accused/applicant herein. On enquiry, the accused has failed to give satisfactory reply with respect to recovery and possession of said contraband substance. Court after hearing both the sides observed that right of personal liberty is most precious right guaranteed under the Constitution and a person is not to be deprived of personal liberty, however, personal liberty of a person can be curtailed in accordance with procedure established under law.
In the present case, as referred above, the applicant-accused has been arrested in FIR No.78/2019 registered in Police Station, Pacca Danga, Jammu for commission of offence under Sections 8/21/22 NDPS Act, for allegedly possessing Psycotropic substance i.e 1000 Capsules of Tramadol which falls under commercial quantity. So, the accused cannot be released on bail at this stage.
Moreover, the offence allegedly committed by the accused is heinous and serious and against the society, so, keeping in view the aim and object of NDPS Act, his release on bail at this stage and moving in the outside-society, would have deleterious effects on the minds of the general public, hence, the applicant-accused is not entitled to bail.
