Court acquits husband, ors in murder case

Jammu, Sept 14: Principal Sessions Judge Jammu VC Koul acquitted Rashid Ahmed son of Kaku, Rafiq Ahmed son of Kaku, Arshad Ahmed son of Kaku and Suriya Bibi wife of Kaku who were facing trial in murder of Shamshad Bibi wife of Rashid Ahmed.
Briefly put the prosecution case is that on 18.10.2014 an information was received from reliable sources in PP Sidhra that dead body of Shamshad Bibi wife of Rashid Ahmed is lying near IMPA building on the edge of the road. The missing report in this respect was recorded in Roznamcha No: 05 dated 17.10.2014 at P/P Sidhra. As the matter was pertaining to the death of female so the cause of death was required to be ascertained and proceedings u/s 174 CrPC were initiated.
Court after hearing both the sides observed that material discrepancies in the statements of the witnesses I am of the considered view that they are not reliable witnesses and their testimonies without any other corroboration from any witness, are not sufficient to prove that it were the accused who committed the murder of the deceased and thus, is not safe to convict them on the incredible testimonies of these witnesses and therefore, for the reasons stated above and in view of the discussion made above, this Court is of the considered opinion that the prosecution has failed to prove the charge against the accused beyond reasonable doubt. As such the accused are entitled to be acquitted. The challan is, therefore, dismissed and the accused are acquitted. --(JNF)
