Court rejects bail in rape case

Jammu, Sept 23: 3rd Additional Sessions Judge Jammu Subash C Gupta rejected the bail application of one Narinder Kumar son of Madan Lal of Deoli Bishnah, Jammu who is allegedly involved in a rape case.
According to the police case that prosecutrix in her written complaint stated that the accused by adopting fraudulent means under the pretext of solemnization of marriage with her, on the intervening night of 29/30.08.2018 forcibly committed sexual intercourse with her in the house of her maternal aunt situated at Kalayana, RS Pura and in the morning he fled away. On this report of the prosecutrix, a case FIR No 55/2018 for the commission of offence under section 376/ RPC was registered with the Police station, Arnia.
Court while rejecting the bail application observed that it is being noticed that there is an increase in graph of crimes against women particularly of sexual molestation/ harassment, sexual exploitation, rape etc. In the present matter, gravity, heinous and seriousness of the crime committed of sexual intercourse can safely be kept in the category of the afore referred offences as same has been committed with the prosecutrix under the false promise of solemnization of marriage, which the accused never wanted to fulfill from the very beginning. Habitual and hardened criminals of sex crimes are hell bent to sexually molest/ exploit the hapless young girls of marriageable age in the name of friendship love affairs and more particularly by making false promise of marriage. Their liberty as generally claimed by them by taking the assistance of fundamental rights enshrined in Constitution of India can safely be curtailed in the interest of society at large. I am hastening to add this can safely be done in the present case also, in order to keep peace, tranquility and law & order in the society. More so, in order to re-impose confidence and trust among the common masses in the administration of justice, more particularly in the judicial system of the country and State of Jammu and Kashmir, rejection of bail application of the accused, is imperative. --(JNF)
