Court acquits six accused facing trial in murder case

JAMMU, Nov 8: Additional Sessions Judge Baramulla Sanjeev Gupta decided the 30 years old murder case in which 12 accused are facing trial, during the trial six accused died, six acquitted.
The case was pending for arguments for the last 15 years which was decided by the Court, acquitted the accused facing trial in murder case.
Additional Sessions Judge Baramulla, Sanjeev Gupta observed that it is apparent that story of laying an ambush by the accused as projected by the prosecution is totally a concoction which is not supported by evidence on record, rather occurrence seems to be an outcome of a sudden scuffle between both the factions in which lathies, stones and an iron rod was used resulting in injuries to both the parties and unfortunate death of deceased. The prosecution on the basis of evidence on record failed to prove that accused persons formed an unlawful assembly with a view to accomplish the common object of doing away with the life of deceased and causing injuries to others. In the ultimate analysis and in the fact and circumstances of the case it is apparent that prosecution has miserably failed to prove its case against the accused beyond a reasonable doubt. Accordingly, prosecution case is dismissed and accused Hassan Lone S/o Abdulla Lone, Maqbool Lone S/o Ahad Lone, Farooq Lone S/o Abdullah Lone, Akbar Lone S/o Jabar Lone, Gull Lone S/o Sidiq Lone and Naba Lone S/o Sultan Lone are acquitted of the charge whereas Mohammad Abdullah Lone S/o Ahmad Lone, Nabir Lone S/o Jabar Lone, Ahmad Lone S/o Mahda , Sona Lone S/o Wali Lone, Habibullah Lone S/o Sidiq Lone Sultan Lone S/o Sidiq Lone died during the trial. -JNF
