HC directs DG to constitute SIT to trace out missing jawan

JAMMU, Nov 15: Justice Ali Mohammad Magrey took serious note of the investigation of missing BSF employee for the last one year, directed Director General of Police, Union Territory of J&K to constitute a Special Investigation Team (SIT) within a week comprising of officers of police not below the rank of Senior Superintendent of Police/Superintendent of Police and Deputy Superintendent of Police. The SIT shall be monitored and supervised by the Inspector General of Police, Jammu.
Justice Ali Mohammad Magrey further directed that after constitution of the SIT, Inspector General of Police, Jammu shall take all effective steps to ensure locating the missing son of the petitioner by putting all apparatus available with the system.
High Court also directed Director General of Police, West Bengal to cooperate as and when asked by the SIT to be constituted in terms of this order for locating the missing son of the petitioner. The SIT shall ensure effective progress without waste of further time and which shall not be a paper work only and file status report after four weeks.
In the petition it has been submitted that the son of the petitioner was serving in BSF presently posted in 113 Battalion, Mahatpur, District Nadia, West Bengal and on dated 14/03/2018 petitioner's husband died and the same was informed to Vishal Sharma, the son of petitioner and the deceased. After getting news of his father's demise, Vishal assured the petitioner telephonically that he will try to get the leave in order to attend the last rites of his father but not reached home till date. When the son of the petitioner not reached home and his mobile phone numbers remained switched off, it forced the petitioner to contact the respondent no 7 in order to know the whereabouts of her son and till date respondents are reiterating that "Regt No.111221642 Constable/GD Vishal Sharma, 'D' Coy of 113 Battalion was granted 30 Days leave w.e.f. 15.03.2018 to 13.04.2018 and left this HQ on 14.03.2018 but individual neither resumed his duties after availing leave nor received any intimation about his absence and forced the applicant to lodge the missing report in this connection. The petitioner then approached Respondent no 3 & 4 but they slept over the matter. Finally, the petitioner approached the court of Munsiff Jammu.
When the matter was taken-up today, Justice Ali Mohammad Magrey observed that this matter has remained on Board for last more than a year but without any progress with reference to the status of the petitioner's son, who is reportedly missing from 15.03.2018.
High Court further observed that this is a matter which concerns the valued life of son of the petitioner, who is reported missing. In the above background, the Court feels it necessary to pass effective directions to ensure adherence to the guaranteed rights of the petitioner for least knowing the progress of the investigation by the Union Territory of J&K as well as Union of India and directed DGP to constitute a SIT. —JNF
