| Pr District Sessions Judge Baramulla settles 35 years old murder case | | | Early Times Report
BARAMULLA, Nov 18: In a landmark judgement towards streamlining criminal justice system, Principal District Sessions Judge Baramulla Sanjeev Gupta has today settled a 35-year-old murder case by acquitting three accused for lack of credible evidence.
As per prosecution case, one Habibullah Bhat went missing on the intervening night of 6 and 7 of November 1986 from his house situated at village Watapora, Tehsil Bandipora. The decomposed and mutilated body of Habibullah Bhat was recovered and found in a gunny bag near a house in the village on 06 December 1986.
However, during the course of investigation, the involvement of accused persons residing in the neighbourhood of the deceased surfaced. It was established during the investigation that deceased was having extra-marital relations with one of the accused who along with her husband and brother hatched a conspiracy which led to the brutal death of the deceased.
After hearing the Public Prosecutor appearing on behalf of the state and counsel for the accused, Principal District Sessions Judge held that as per evidence tendered in the case, the prosecution was not able to prove the motive behind the murder of deceased by the accused.
The Judge, who is also holding the additional charge of court of Additional District Sessions Judge Baramulla before which the case was pending for over 30 years, held that the recoveries made at the instance were also held to be planted in order to frame the accused in the crime.
Sanjeev Gupta, while giving benefit of doubt to the accused has observed that prosecution was not able to prove its case beyond a reasonable doubt and acquitted them of the charge of murder. |
