Jammu, Nov 22: High Court has sought detail of officers who served Directors' Tourism Department and the Chief Execute Officers (CEOs) Patnitop Development Authority (PDA) in fifteen years.
The A bench of Chief Justice J&K High Court Gita Mittal and Justice Rajesh Bindal issued the direction over violation of building persimmon granted by PDA. "It submitted by F. A. Natnoo, AAG that he has examined the case totally and prepared a complete report in terms of our last order dated I5th October 2019. He seeks a shun adjournment to place the same before us. Let the same he placed on or before next date", the order read and added, "During the course of hearing, our attention is drawn to the fact that several persons, who were granted permission to run Guest Houses, have violated either the building permission or the terms on which the permission was granted."
"Permissions for running, Guest Houses are being misused to run the Hotels. It is implicit in such violations that the terms on which the permissions stand granted, have been violated and therefore, the same cannot be permitted to continue", the bench observed and added, "We direct the CEO of the Patnitop Development Authority to send a list of all properties, where there are violations of construction permission as also where hotels are being run illegally to the Director of Tourism." "The Director Tourism shall give a short notice to show cause to the persons, who have misused the permission granted to them before taking appropriate action in accordance with the law. Immediate steps will be taken and the permission granted to such persons, who have violated the same shall be withdrawn immediately thereafter", the order said, adding that action taken report shall be filed before this Court. "Pran Singh, CEO of the Patnitop Development Authority has brought to our nonce the case of one 'Hotel Severa' owned S. Nfohinder Singh and S. Suroop Singh. Demolition notice dated 8 January 2002 was issued by the Patnitop Development Authority to these persons, which was the subject matter of challenge before the J&K Special Tribunal. The Tribunal had dismissed the case by an order dated 21st April 2006. Yet no action has been taken in respect of illegal construction", the order said adding that the report placed before us by Pran Singh, CEO, Patnitop Development Authority also discloses that as per the spot inspection by the Committee, a large number of hotels, who were granted permission of the area approved for construction have encroached upon large amount of public property or have illegally constructed way beyond the area. "The respondents shall place before us the list of all the Directors of the Tourism as well as CEOs of the Patnitop Development Authority in the last fifteen years and the period for which they were so posted", the order read.
