Govt Deptts implement 7 state laws with amendments

srinagar, Dec 13: Government departments have initiated a process to implement at least seven acts of the erstwhile state laws with amendments in the new Union Territory.
At least 164 state laws have been repealed from November 1 when Jammu and Kashmir was officially declared a union territory.
With the abrogation of Article 370, 106 central laws have been implemented in Jammu and Kashmir.
At the same time, government departments are implementing seven erstwhile state laws with amendments in Jammu and Kashmir.
These laws were in place but are again been implemented in the new Union Territory but with several amendments.
Under the new tweaked Transfer of Property Act, the government has decided to delete section 139 and 140, which was restricting certain institutions to acquire immovable property in Jammu and Kashmir. With new amendments, the non state subjects can buy property in the new Union Territory of Jammu and Kashmir
Similarly, there would be no prohibition on transfer of land to non state subjects as the new UT administration is planning to delete Section 17 of Jammu and Kashmir Agrarian Reforms Act. The Act was framed in 1976 to transfer land to tillers on certain conditions.
Section 20A of the Land Estates Abolition Act has also been removed, which prohibited transfer of land to non-state subjects.
Sources said in the Cooperative Societies Act, sub-clause (ii) of clause (a) subsection of section 17 is also being removed. Under this section no person shall be admitted as member of co-operatives societies without being a permanent resident of Jammu and Kashmir. Similarly, no firm ought to be registered provided that its proprietor is permanent resident of the state.
Similarly, section 4 and 4-A of Jammu and Kashmir's Alienation of Land Act has also been removed. These sections prohibited transfer of land to non-state subjects.
There are several other state laws like Jammu and Kashmir Reservation Act, Jammu and Kashmir Land Grants Act, which are being implemented only after amendments.
