NIA Court acquits HM OGW as prosecution badly failed

SRINAGAR, Dec 14 : Special Judge Designated under NIA Act Srinagar, Ashwani Kumar Sharma acquitted one Over Ground Worker (OGW) of HM as the prosecution has badly failed to establish the guilt of the accused beyond reasonable shadow of doubt.
The OGW, Mohd Ayoub Dar son of Ghulam Mohd Dar of Subhanpora, Bijbehara, district Anantnag was acquitted as no evidence has come against the accused for commission of offence u/s 18/19 of UAP Act, 1967.
Court observed that there is no disclosure statement of the accused with the file as alleged by the prosecution, that during preliminary enquiry it was disclosed by the accused that he is an OGW of banned outfit HM and harbours and provides food to them. In these circumstances the accused is acquitted of the charges leveled against him U/s 18/19 of UAP-Act, 1967, by giving him the reasonable benefit of doubt.
The accused is hereby set at liberty forthwith. The bail bond and personal bond of the accused shall stand withdrawn. There is no seized property in the case as such no order can be passed viz-a-viz the same. The file after its due completion be consigned to records. (JNF)
