ALC Kishtwar finds gross violation of labour laws during inspection of 1000 MW Pakkal Dul HEP

Kishtwar, Jan 18:Taking congnizance of the complaints received from various quarters and in order to ensure that laws for the welfare of labour class are implemented in letter & spirit and further to ensure that basic facilities are provided to employees working at Pakkal Dul Power House site at Dul kishtwar, Assistant Labour Commissioner (ALC) Kishtwar, Anoop Kumar conducted the inspection at various works being executed at Pakkal -Dul Power House site.
He was accompanied by the Labour Officer Kishtwar, Fulail singh during the tour.
During the course of inspection, ALC found that various Contractors have engaged labourers without registering under Contract labour Act,1971; Building and other Construction workers Act ,1996; Interstate Migrant Workmen Act,1979 ;Motor Transport Workers Act,1961 besides they are executing work through labourers without issuing any appointment orders, Identity Cards, wage slips and other requisite documents thus rendering poor labourers vulnerable to exploitations.
He further enquired about minimum wages provided to the labourers, Muster roll, overtime register, paid holiday, register of wages, register of overtime, Employment certificate, service certificate & display of information at conspicuous places/ Notice boards by the employer and found that nothing in the prescribed formats were maintained either by AFCON Company nor by their sub contractors.
During interaction with various labourers which included skilled, semi- skilled & unskilled labourer he enquired about various facilities provided to them by the company and found that most of the labourer engaged by Sub-Contractors are paid delayed wages in contravention to the Payment of wages Act,1936 and Payment of Wages rules,1937.
While inspecting the food he found that food for labourers is being supplied by the Company from mess to the work site in the banned plastic bags without any due care of hygiene and directed for maintaining the proper hygiene and No use of plastic for supplying food.
He personally inspected the first aid facility, Mess, safety gears, drinking water facility, residential facility, availablity of rest room & toilets among others.
He further assured to the labourers that action as per the provisions of various labour laws shall be initiated against the Employer/Contractor for violations so that the labourer shall get their due right.
Updated list of the contractor's with complete details was also sought by him from the company for proper implementation of labour laws.
