Court takes serious note for not filing report in Kishtwar militancy case, directs IG for enquiry

JAMMU, Jan 28: In a much publicized case of Kishtwar militancy, 3rd Additional Sessions Judge Subash C Gupta today took serious note over the functioning of police for not filling report despite repeated orders by the Court, directed IGP, Jammu Zone for making an inquiry in the matter as ordered herein above and submit the detailed report in this regard. Simultaneously, he is directed to submit the police report and CD file in the present matter on next date of hearing.
It is worthwhile to mention here that Court had already rejected two bail applications.
Today when the other two bail applications filed by Riyaz Ahmed S/O Abdul Qayoom R/O Sarkoot Kishtwar and Devi Dass S/O Hari Dass R/O Lower Janak Pur Tehsil Dashin District Kishtwar was taken up, Court observed that APP of the court has shown his inability to file the police report.
According to him, he flashed many messages and made phone calls to the concerned police for submitting the police report. These applications appear to have filed by applicant /accused –on 31-12-2019 and 08.01.2020. Thereafter, for five times, it has been adjourned as per the request of the prosecution for submitting of the police report. However, it is sorry state of affairs and not known as to why the police report has not been submitted for the last about one month.
Court further observed that today, also, prayer is made for adjournment for submitting of police report by the APP. Last and final opportunity is given with a condition that in case of failure, appropriate order under law will be passed in the matter. However, it is very much imperative to have a detail inquiry in the matter as to why the police report is not being submitted by the concerned police. Accordingly, it is ordered. Copy of this order is forwarded to IGP, Jammu for making an inquiry in the matter as ordered herein above and submitted the detail report in this regard. Simultaneously, he is directed to submit the police report and CD file in the present matter on next date of hearing. -JNF
